The "Hillary is a criminal" thing was an astroturfed pile of bullshit propaganda invented by the right wing hate machine to stain her. That's it; that's all it is. I'm pretty sure they knew full well that she would never, ever end up in jail over it but that's exactly what they needed. To the right wing base she was a criminal that should be fought and destroyed at all costs; she is an unperson to them. If she ever did actually get prosecuted/thrown in jail they'd have to pick a new Great Enemy.
