I thought about posting this earlier for the fun poo poo in the background (sunsetting VISA laws, EVENTUALLY making Mexico pay for the wall, etc) and decided against it, then I just realized that Bannondorf didn't hide his CAC. The whole reason you get overtime is because there isn't enough workers.

Hire more employees costs more than just paying some overtime from time to time.

The comp time would have to come out of the same pay check period for me to not string up my employer.

They bitch and cry about being short and "can you stay an extra hour we really need coverage because this lazy poo poo called out again and we will totes make up for it by letting you out early tomorrow..". Then they do that 3 of the 5 days a week, while running you right to the clock on the other two and when they find out you are in overtime after the fact they throw a gigantic poo poo fit about you not adhering to the schedule.

Or is that just a handful of states where that fuckery is legal? Because it was done all the time in more than one place I have worked.

Maybe I am misunderstanding something and this doesn't do what I think it does? Or I have been screwed by employers doing things they weren't legally allowed to do?

What this means is that classified employees can now be forced to take comp time in lieu of overtime pay. So if you work 60 hours in one week, instead of getting 20 hours of overtime, you'll get 20 hours of comp time. The scenario you described is illegal in a lot of places.

I'm pretty sure different states have different regulations on how paid time off is regulated with regards to the proportion of the time's value your employer has to pay you. Depending on how that federal law is written you might only end up getting 70% or so of the value of your time if you cash it in at the end of the year, instead of the 150% you're currently entitled to.

What I originally thought was that the law would allow companies to give you time off or defer hours from the end of your work week if you worked over time. In other words say its Wednesday and you are already sitting on 32 hours because you were working late every day. Instead of working the remaining scheduled 16 hours and getting ot, they cut 4 hours both days or have you stay home one. Which would get you back down to 40.

What the bill actually does is you work 48 hours and instead of getting 8 hours of OT they just say we will eventually give you 8 hours of time off. Which is wage theft.

I knew when I first looked at it, I knew I had to be missing something and turns out I was.

If they made it 12 hours it would be remotely fair. But no they always gonna try to gently caress the little guy. Some industries simply cant hire on people quick enough to deal with spikes in labor. Not sure if a lot of companies would actually be down for this.

Im a PT supervisor at UPS and this bullshit bill is how UPS does their FT supervisors during peak season. They work 60 hours a week on average for about a month but they are salaried. THe company "reimburses" them with extra PTO.

The funniest thing (i.e most horrible) about that rule is....they dont get enough time to use all of their existing PTO during the year anyway (its all mgmt discretion and UPS blacks out the entire month of december til january 2nd for vaca requests). Im not sure if they get paid out for it, but if they do its probably straight time instead of time and a half.

And these are the same loopholes that will be abused for everyone now! :v:
