But the NFL’s Board contrived a rule that previously did not exist. It created a procedural hurdle. Because of the first denial, Solomon had to file a second claim with the Board. The Board denied the second claim, stating that the evidence in this multiple appeal case needed to be “contemporaneous”. The Court observed that the NFL has no such rule. Worse yet, the NFL did not even tell Solomon of this new requirement so he could have complied. The irony, of course, is that there was enough uncontroverted evidence to support the award of benefits in the first place. A multiple appeal should not have been necessary.

Why would the NFL decide to appeal in a case in which they clearly had no evidence to support a denial of benefits?

The logical assumption is that the NFL just waited to see if Solomon could muster the resources to continue the battle on appeal. The NFL is probably well aware of the fact that over half of NFL players file for bankruptcy within five years of retirement. It is hard to conclude that the NFL appealed because the evidence justified the denial. It had no evidence. Integrity issues arise and a miscarriage of justice results in such circumstances.

I think that will change over time as people who are young now become the old white men of the NFL. But you're right I'm definitely not holding my breath for it anytime soon.

That being said I was actually pretty surprised at how lenient the testing actually is. Under contract you just need to get clean to pass one test, and you know it's going to be in a span of 3.5 months. If you do accidentally fail, you get several chances to get clean before a suspension is even considered. I had thought the policy was stricter than that for sure.

It is not. Which is why the Josh Gordons of the NFL are total idiots.

Ah I see I misunderstood. Yeah imo there's no wrong way to use it; if it helps you in any way even if it's just mental then that's a good thing. The California law which really got the medical thing going was written exactly like that, anyone could get a card and it's basically their decision if it helps them or not. Hopefully someday marijuana is just completely removed from the schedule and hiring/firing decisions based on one's medical/recreational choices are made illegal under equal opportunity laws.

You're right that if he had a past history of being aggressive towards other dogs, he shouldn't have been there. But being off leash is the point of a dog park. In fact, bringing a dog into a dog park on leash is a good way to start a dog fight.
