The person with more votes should get it.

Look just because Biden has spent his entire political career leading the charge on pushing the Democratic party right wing, attacked social security, passed racist crime bills and openly palled around with the worst psychos of the Republican party won't mean that he'll continue to do that once he's president. I firmly believe he'll put a trans woman of colour on the Supreme Court because he'll be thinking about his base.
