If you shoot at somebody and have really terrible aim; the guy isn't even bothering to doge your bullets; and he gets hit by a car and dies, it's murder on your part. The defense has two avenues of attack: that knee-on-neck-9-minutes is an appropriate and usually safe maneuver, or Hail Mary and hope that the jury ignores instructions and decides that killing a black druggie is fine.
