The defense’s filing petitioned the court to rule that statements the defendant made as a minor to his father, Jim Bob, and family friend Bobye Holt were “shielded from disclosure by the clergy privilege.”
Holt spoke to the court in a pretrial evidentiary hearing on Monday, stating that she couldn’t remember if there were any confidentiality rules established when she and her husband went to the Duggar’s home in 2003. She added that she and her husband both gave advice to Duggar at the time and that women don’t typically do that in their church.
Holt said she was never a leader or elder in their church, Bible Grace Fellowship Church. She said that women typically aren’t included in confidential conversations with church elders and that the discussion with the Duggars at that time was one of parents talking with parents, even though she did remember some prayer being involved.

She stated multiple times that it was not a “church conversation.”
The motion addresses statements made by both Holt and Josh Duggar’s father, Jim Bob, in court Monday. The defense notes that “the testimony makes clear that Jim Bob and, by extension, Duggar—who was a child when he allegedly ‘confessed’—reasonably believed both Jim and Bobye were spiritual leaders of the church.”
The defense filing adds that even if Holt was not a church elder, it is “critical to note that the [clergy] privilege still applies if Duggar ‘reasonably believed’ that Bobye was a spiritual leader of the church.”
The judge is expected to rule on this motion and any others filed today, as well as earlier filings by both sides.

Before the jury went into deliberation, the defense team presented its closing arguments.
Justin Gelfand noted that the defendant has no burden of proving anything and that the prosecution had to dispel reasonable doubt - that every doubt had to disappear unanimously.

He made a comparison between computer forensics and DNA and said they followed the evidence "together."
House of cards'
Gelfand continued, saying the prosecution's case depends on Duggar being behind the computer. "If not, their case crumbles like a house of cards," he added.
Gelfand noted that Michele Bush and James Fottrell agreed that remote access was a possibility, adding that Bush was not able to rule out remote access.
He then went over six reasons why remote access was a possibility.
Six reasons
The first reason Gelfand noted was the universal plug and play, saying Fottrell testified it would make a network more vulnerable. He noted that the HP computer had plug and play enabled and that its network through the connected router was vulnerable.
Gelfand added as a second reason that the HP streams through a router. He said every video file was streamed and that, while confusing, the data was critical.
"The real evidence is on the router," Gelfand said.
He noted that too much was at stake for Josh Duggar and that the router would tell them what devices were connected.
"Why don't we have the router?" he asked, claiming that the government did nothing to consider remote access.
Gelfand said both experts agreed to the possibility of remote access and that the prosecution didn't mention the forensic data in their closing argument.
Size and timing
Gelfand continued with a third reason. He said the small size of the partition suggested whoever set it up knew it was not big enough to keep videos and images.
He claimed that activity was inconsistent with Duggar and made no sense.
Gelfand then noted the short time period of the alleged crimes. He said everything happened over three days in May 2019.
Deletion of the material
Defense attorney Gelfand's fifth reason was the immediate deletion of one of the files.
He noted that the 33-minute video of child sexual abuse in question was sent to the trash 29 seconds in and deleted.
Gelfand said not all of the files were in the trash or computer and that Michele Bush claimed they were moved by remote access. "The forensic trail clearly answers that," Gelfand told jurors.
The sixth reason
Finally, Gelfand had a sixth reason for the jurors.
Over a five-year period, he noted, on Josh Duggar's iPhone and Macbook, there was no forensic trace of child sexual abuse material being downloaded or viewed.
He noted that Fottrell said it could have been wiped clean, but there was no forensic evidence of that
Defense closing continues
Gelfand continued, saying there was no reason for someone with access to the HP to stream videos instead of double-clicking on them.
He said the Linux logs were written over because Homeland Security Investigations waited six months.
Gelfand then claimed that Fottrell lied, noting the software he asked about and whether it was plugged into the internet didn't exist in 2019.
He added that the government played disturbing images and videos that didn't come off the device but from a thumb drive from Washington, DC, from other cases.
Gelfand then brought up that the government tried to pass off Tor as a bad thing, but it had been on the Macbook since 2017 and nothing bad was done with it.
No connection
Gelfand said the thumb drive with two documents and one Powerpoint was plugged into the HP computer and files were downloaded, but that there was no connection to Josh Duggar.
He also noted the Dell_One username, and said no Dell has been connected to Duggar. "Josh is a Mac guy," he said.
Gelfand then brought up uTorrent, Tor, VLC, and command lines, telling the jurors Bush said the Snap Store had no uTorrent option.
Transmission use
Next, Gelfand noted that Josh Duggar used Transmission and BitTorrent on the Macbook from 2017 and that uTorrent was on the Linux.
He said someone decided to not use Transmission when Duggar knew how to use it.
Starstruck'
Gelfand suggested next that the prosecution was starstruck, and that when they realized the house from the search warrant wasn't Josh Duggar's, they sent someone "laser-focused" on finding him at the car lot.
He said the government didn't look at anyone else and had "excuses for everything."
Previous allegations
Gelfand said the prosecution "dug up" allegations about Josh Duggar that were 20 years old when he was going through puberty, noting that Duggar went to his ex-girlfriend's mother to confess.
"That's not why we are here," he said.
Smoking gun'
Gelfand said the only piece of evidence the government brought forth from May 13 was a single photo, that that was their "smoking gun."
He then turned to the evidence from May 15, when Josh said he was at the car lot and a customer said he would be there in 10 minutes.
10 minutes later, Gelfand noted, the child sexual abuse material was downloaded.
He added that the customer was expected to show up at any moment when that occurred.
Reasonable doubt
Gelfand told the jurors if they agreed remote access was possible, that was reasonable doubt, and that the law demanded they return a verdict of not guilty.
He added that no one appreciated what they were about to do more than Josh Duggar.
"Everything is on the line," Gelfand said. "We ask that you find him not guilty."
