I called a lawyer and he was not remotely optimistic about it, said to call back if it's "serious" because otherwise it's not worth it since the cops said it wasn't her fault

I just, I actually don't know what to do. I can't work so I'm completely broke and homeless. I mean, I've been homeless for a couple months now, but I was working every day, it was by choice. I've just been looking for an apartment very slowly. The place I've been staying at off and on is almost certainly not gonna be cool enough to let me stay without paying for even one day. I have a car though, so I guess I'll be "fine"

I just, I really loving wish I had even one friend in this town now, all my family is 1000+ miles away and they're all so broke they can prolly only send me like literally 50 dollars

Shouldn't either your or their car insurance cover any medical related stuff? I know insurance stuff varies wildly by state, but something similar happened to me a good 10 years ago and despite my car being 200 miles away my car insurance still covered the medical stuff, tho the two companies fought about it i guess.

The only real stinker with records of what happened is if the cops how the cops stated his location because they assigned him fault. He said/she said when one side is a cop who immediately wrote their said down does not favor the homeless person.

A hefty assumption. Cops will always do the bare minimum paperwork wise and avoid if they can. Words are confusing and hard.

Last time I gave a statement for someone who got smoked by a red light runner, the lawyer was super confused because the cops notes had the directions completely reversed, despite me giving a statement directly to the cop as well, and them being literally on the scene seeing how it was laid out.

Their first question to me, while giving first aid to this injured person while waiting for the medics was "was she wearing a helmet?"

And I'm like no, but that person clearly blew the red, I witnessed it and these other people did too, is that really what's important here? Can we at least ticket the driver for that?

And the cop is like "well, I could give [injured person] a ticket (like $40 here) for not wearing a helmet" and saunters off uselessly.

Then medics arrived to take over and move them to hospital, and bystanders arranged to transport their bike somewhere safe until they could get it back, giving the person contact info.

Police will never help you.

It just baffles me that the woman didn't even think about offering aid of any kind. I guess the cops and emts present didn't help with how they called it.

Where were you standing anyway? You said the cops said you were a few feet from the intersection but that could be anywhere from jaywalking, to in a crosswalk, or God help us if this is the case on the freaking sidewalk waiting for your turn to cross.

oh yea, lots of stores and lots have cameras pointing outside, if this was near some businesses you should
ask the bosses who work there if they have any cameras pointing towards the street. since the police
don't agree with you about fault you'll have to get a lawyer to force them to get any surveillance footage.
you should do this asap cause stores don't usually keep footage past a week or two.

I was walking home from work one afternoon, during daylight, and was crossing a driveway connected to a local business. Note I was on a legal sidewalk and the driveway no less than 8ft wide, it had that white stripping indicating ped crossing. No car at the time, I began to cross...

Car comes flying around from behind the business, I'm maybe 2ft into the driveway and they graze me. In my rage I did a flying dropkick into their rear fender panel, putting a good solid 4"deep dent into their nice Mercedes.

I hear "wtf" from inside the car as they pull out and speed off. Didn't even bother to check me, their car or anything. I whip my phone out and get some nice photos of the car, dent, rear plate and my scrapes...

Cop was about 2 mins down the street, I flag him over and report that rear end in a top hat as hit and run. Cop hmms and haws before finally calling it in. Said it was unlikely that they'll catch the guy. Like, dudes, you could EASILY catch them, but they absolutely didn't want to because it involves a rich person and paperwork..

Months go by and I settled with the driver out of court for a few Gs... But you absolutely need proof, patience and support.

I feel for you, but unless you absolutely and relentlessly pursue the matter, everyone is going to tell you to just let it be.

I googled Denver pedestrian right of way and Google says since you aren't in the crosswalk 10 feet away, you don't have a leg to stand on legally, and only one, physically.

Sorta.

Jay used to be a pejorative about criminals, iirc. Back then people could just wander through the streets. Car companies wanted the streets for their own so started an ad campaign with slogans like "don't be a jay, use a crosswalk" or something like that. It was pretty successful because now cars are viewed as superior to people.

Kinda like how corporations are people.

Kinda like how the US has fallen over a cliff and is going to crash completely and irrevocably, hopefully soon.
