i've never seen anyone using generative fill on a stream even though it would currently be allowed

i don't think there's much overlap between the kind of artist who would stream their process and the kind of artist that would replace a big chunk of their process with generative sludge, like the whole point is to show the execution of an idea from start to finish, and shrugging and just letting the computer guess what they were trying to do is the opposite of that

Pretty sure Twitch is intentionally not policing poo poo like that and it's up to the copyright owner to press the DMCA button or whatever. Back when they cared about the Artifact category being abused, it was people streaming porn or other gross poo poo. I think it's out of that weird idea that not proactively moderating your users' content at all leaves you more DMCA protected. Source: I talked to moderation people at Twitch about it but it was years ago so I might be misremembering.

Well this explains the kids learning how to make money part, I was unsure if that was a Fox News talking point or you had some personal history and didn't want to ask. Some context and a deep breath would have made this thread a less lovely experience

The idea is that if they acknowledge that rights breaking exists by moderating it, they'll be on the hook for it. If the rights holder has to send in a DMCA, they can go "As soon as we were notified and discovered that they were in fact streaming MMA matches and not playing a super realistic video game, we handled it". I'm pretty sure they'd still get hosed in court, but as far as I know, none of the major platforms have actually been in a case where it's been addressed.

yeah 17 usc 512(c)(1)(A)'s subparagraphs mean twitch only escapes liability if they don't have actual knowledge of copyright violations and they're not aware that infringement is apparent. (iii) seems to indicate that if they do know (by looking for and finding pirate streams, or getting a notification) they have to "act expeditiously" to shut it down. safer not to look and rely on getting notices from copyright holders.

a bunch of people are still getting smacked for drawing, the same exact thing they used to draw, and weirdly its mostly female artists. like drawing a bit of cleavage is getting hit lol. bascially all twitch's 24 hour tos change did was rile up a bunch of goobers to mass report every lady on the site, and twitch is immediately kowtowing to them because presumably people who actually matter got mad at their policy changes, like credit card companies. internet ftw.

There was someone on Twitter who went around taking screenshots of artists streaming their process, then running the finished piece through one of the picture-editing AI sites and pretending that they did the art by hand by using the screenshot as proof.

It was a whole new level of lovely.

if that's the incident i remember they didn't even wait for the artist to finish the piece, they just screenshotted the WIP, ran it through img2img, and posted it as their own before the actual artist could even finish it

It seems like it'd be easier just to ban AI generated content on twitch than have to constantly tweak the rules to compensate for weird freaks using AI to generate child porn or whatever they're doing, given that it's just a constant mire of legal, moral, and ethical issues.

banning unsupervised AI streams in general would probably be prudent, even before the boob incident it's already caused trouble when people were running LLM-driven seinfeld or family guy bots and getting banned when the computer made a transphobic joke or bomb threat or whatever
