As far as I can tell, nobody testified that is wasn't punishable, only that under some conceivable circumstances it wouldn't technically violate bullying and harrassment policies specifically. Most of the testimony I could actually find transcripts of was about how easy it WOULD be to still break those policies. It's also just notable to see how hard "free speech on campus" crusaders do a 180 when the speech in question is not about trans people or race science.
