Even if you've never read one of these before, you can see how much room they have to freehand context, right? They have wide latitude over that. And they use it to detail how to discriminate and what they won't do to stop it. Entirely optional! You don't have to write that!
To be clear they have wide latitude to write whatever reg language they want, too - I just figure lay people should easily be able to see all the completely unnecessary ratfucks in the prose. This is not how I would have written any of it, obviously.
And from what I'm hearing (and def what I'm seeing in the reg) I'm actually not sure we even had anybody at the table. NCTE worked closely with the Obama admin on the 2016 reg. This looks like no trans policy person was within a hundred miles of it.
I keep saying the unionbusting debacle set us back like 15 years of trans policy pipeline development and this is a good illustration of what that cost us.
