Also there was a good interview on Pod Save America with Elizabeth Warren yesterday about both the Dodd-Frank law that created the CFPB and the Federal Vacancies Reform Act that Trump is using to put Mulvaney in place. The FVRA provides applies to all federal agencies in existence at the time of it's drafting, and only applies to federal agencies created after it's drafting if they do not have a designated succession plan provided for by Congress. The Dodd-Frank law that crated the CFPB originally linked to the FVRA for it's succession plan, but that was deliberately taken out during the drafting and replaced with it's own leadership succession plan specifically to avoid this exact situation. It was created with a maximum amount of independence from both the legislative and executive branches, to the point that it is self-funded through fees and fines so it's budget can't be zeroed out, and that the only thing the executive can do is appoint a director for a statutory term of 5 years, and the only thing the legislature can do is confirm the appointment. I would not expect Mulvaney's interim appointment under the FVRA to survive a full court challenge based on a review of legislative intent. The injunction was blocked by a judge who was appointed by Trump over the summer.
