US taxes are loving stupid. Okay, Rumsfeld is a dick, but he's not wrong. He's just banging on about it for the wrong reasons. Our tax code is one of the single best anti-government arguments, not because of the amount, but because of how convoluted it is.

The depreciation would have to be recaptured, then capital gain applies to the difference between the sale price and the original purchase price. I suppose you could use some shell company voodoo to avoid recapture, but it seems more likely that the author of that article doesn't understand capital gains.
