There's a list of rules the creator (ZUN/Team Shanghai Alice) came up with in regards to fanworks. Basically you can make what you want using the game's setting/characters without paying any royalties, but you need express permission to sell it outside of like conventions or w/e. The reason for this is that ZUN wants to maintain the "doujin" (fanmade) spirit of the series, cause even the official stuff is sold exclusively in conventions and the like. A recent kickstarter failed because ZUN felt that receiving production costs is essentially too commercial. It's a pretty neat system.
