http://www.theguardian.com/world/2014/jul/03/revealed-coalition-to-use-national-interest-test-to-deny-permanent-protection-visas?CMP=soc_567

quote:

The Abbott government has decided to use a new “national interest test” to deny permanent protection visas to refugees who have arrived “illegally” by boat or plane in an attempt to circumvent its stunning loss in the high court last month and implement its policy to refuse permanent settlement to all boat arrivals.

The extraordinary move – revealed by the government to stakeholders on Thursday – says immigration minister Scott Morrison will personally decide the new “national interest test”, which will take into account whether giving a permanent visa would:

  • Provide a product for people smugglers to market now or in the future, when it is in Australia’s national interest to combat people smuggling whether by sea or by air, and to prevent deaths at sea arising from people being put on dangerous journeys to Australia by sea by people smugglers
  • Erodes the community’s confidence in the effective and orderly management of Australia’s migration program, and undermines the integrity of Australia’s visa systems and its sovereign right to protect its borders
  • Reward people who arrive illegally with the same permanent visa outcomes available to people who abide by Australia’s visa requirements. If a person who arrives illegally is found to engage Australia’s protection obligations, their protection needs can be met through the grant of a temporary visa.

The wording of the conditions makes it clear the intention is to refuse permanent visas in almost all cases.

From what she was telling me, they were held much more accountable back then than the JSA's are now.

Having been on the books of a JSA back in 2002-2004, they do sweet gently caress all. They MIGHT give you something small to help (I got a multitrip for the Adelaide transit network to get to interviews) but overall they just pocket what they can. Dunno if this has been posted:

http://www.theguardian.com/world/2014/jul/03/asylum-seekers-may-be-subject-to-speedy-on-water-screenings

quote:

Here's how the process works.

One immigration officer conducts a short interview to screen asylum seekers in or out. The interviewing officer will sit down with the asylum seeker, in person or via teleconference. Sometimes a translator is present, sometimes on a phone line. A previous template of the interview from April 2013 shows that the officer will say the following words:

“Because you arrived in Australia without a visa you are an unlawful non-citizen and do not have an automatic right to remain in Australia. Therefore a finding is to be made as to whether you have a valid reason to be allowed to remain in Australia. The purpose of this interview is to inform that finding by collecting information about you and your reasons for coming to Australia.

“If on the basis of the information that you provide or is otherwise available to the Australian government it is found that you should be allowed to remain in Australia, then you will be advised about how your case will proceed in due course.”

Then come the questions: “What are your reasons for coming to Australia? Do you have any other reasons for coming to Australia? Would you like to add anything else?”

If the detainee does not raise a red flag by saying they want to seek asylum because they fear persecution, or if the interviewing officer does not believe them, they can be screened out and deported. While a review can take place, Guardian Australia’s analysis shows the department’s records don’t always show that a review has happened.

Last year the speedy nature of the process caused human rights groups and the UNHCR to express serious reservations about screening. Reports of the new “on-water” approach to screenings has escalated these concerns because it makes it even more difficult for asylum seekers to gain legal advice before they undertake an interview.

The Australian director of Human Rights Watch, Elaine Pearson, said the reports were “extremely concerning” and described a practice that was “probably unlawful”.

Katie Wrigley, a principal solicitor at the Refugee Advice and Casework Service, said: “It would be almost impossible for the people in that situation to access legal services. It’s already incredibly difficult for clients in remote centres to access services, but if it’s a person on a vessel that would be near impossible.

“We would hold very grave concern about individuals not being able to access legal advice if they were held on board a vessel.”

The immigration department has previously received advice from its own legal counsel that the on-water approach may be unlawful. Guardian Australia reported on Wednesday that the department had previously considered using the customs ships Ocean Protector and Triton as “motherships” to screen asylum seekers secretly on the vessels.

Guardian Australia asked the immigration minister’s office whether new advice had been received on the screening of asylum seekers on board customs vessels. It did not respond to questions.

Note the graph immediately before the quoted text on the page, which is a bit interactive to capture. It says that since last October ie the start of this government, all screening results have been negative, 100%.

The funny part of this is that I've only really used Steam in the last 5 years, which is funnily enough when I started working full time and have been working so to the present day. Remember when I was volunteering helping the asylum seeker family? I stopped doing it (had no funds for petrol at the time), and received a phone call at work just the other day. It was the father of the family, who I hadn't talked to in about twelve months.

He had a lot to say, though what stood out was his greatly improved English - he can talk without having to pause and think about his words, and has reached a stage where anyone off the street could understand him clearly. He is working six days a week as a labourer, a field he wanted to continue to work in. His children are still attending school, and they are doing very well. The eldest one is in high school now.

I believe that if you are selling me a Big Mac or any other item, you should do it in English. I believe there should be no other language option.
I believe everyone has a right to pray to his or her God when and where they want to.
My heroes are, fellow Australians like Don Bradman, Steve Waugh, Alan Langer, Slim Dusty, Fred Hollows and the Aussie scientists who invented the bionic ear - missed a few I know.
I don't hate the rich, but hate the way they always find ways to pay less taxes. I don't pity the poor, I hate the way they are always crying that they are hard done by!!
I know wrestling is fake and I don't waste my time watching or arguing about it.
I believe if you don't like the way things are here, go back to where you came from and change your own country!
This is AUSTRALIA....We like it the way it is and more so the way it was...so stop trying to change it to look like some other socialist country! If you were born or legally migrated here and don't like it... You are free to move to any Socialist country that will have you.
I want to know exactly, where the "Do Gooder's" get their money from, and why are they always part of the problem and not the solution?
I also think the cops have the right to pull you over if you're breaking the law, regardless of what race, colour or creed you are, but not just because you happen to be an illegal alien and scream that they are "RACISTS PIGS". And, no, I don't mind having my face shown on my driver's licence. I think it's good....
I dislike those people standing at the intersections trying to sell me stuff or trying to guilt me into making 'donations' to their cause....Get a job and do your part to support yourself and your family!
I believe that it doesn't take all the intellectuals to raise a child, it takes two parents....
I believe 'illegal' is illegal no matter what the lawyers think!
I believe the Australian flag should be the only ones allowed to be flown in Australia!
If this makes me a BAD Australian, then yes, I'm a BAD Australian. If you are a BAD Australian too, please forward this to everyone you know....
We want our country back!
My Country..... I hope this offends all illegal aliens.
My great, great, great grandfather watched as his friends died in the Boer War.
My grandfather watched and bled as his friends died in World Wars 1 and 2.
My grandfather watched as his friends and brothers died in the Depression of 32.
My father watched as his friends died in Korea.
I watched as my friends died in Vietnam, East Timor & Desert Storm.
Our son's and daughters watched and bled as their friends died in Afghanistan and Iraq. None of them died for the Afghanistan and Iraq Flag. Every Australian died for the Australian flag.
Our young folk should show far more respect for our elders who have fought for our freedom and worked so drat hard for the huge benefits that we all now share.
At a Victorian high school foreign students raised a Middle East flag on a school flag pole. Australian students took it down. Guess who was expelled...the students who took it down.
West Australian high school students were sent home, because they wore T-shirts with the Australian flag printed on them.
Enough is enough.
This message needs to be viewed by every Australian; and every Australian needs to stand up for Australia. We've bent over to appease the Aussie-haters long enough. I'm taking a stand.
I'm standing up because of the hundreds of thousands who died fighting in wars for this country, and for the Australian flag.
And shame on anyone who tries to make this a racist message.
AUSTRALIANS, stop giving away Your RIGHTS!
We should never – never be allowed to sell ANY farm/country land to overseas interests.
They say Fiji is a third world country – yet they NEVER sell “their land” – they will only lease it to foreign interests – Australia should do the same.
THIS IS OUR COUNTRY!
This statement DOES NOT mean I'm against immigration !
YOU ARE WELCOME HERE, IN MY COUNTRY, welcome to come legally:
1. Get a sponsor!
2. Learn the LANGUAGE, as immigrants have in the past!
3. Live by OUR rules!
4. Dress as we Australians Do
5. Get a job!
6. Pay YOUR Taxes!
7. No Social Security until you have earned it and paid for it!
8. NOW find a place to lay your head!
If you don't want to forward this for fear of offending someone, then YOU'RE PART OF THE PROBLEM!
We've gone so far the other way...bent over backwards not to offend anyone.
Only AUSTRALIANS seem to care when Australian Citizens are being offended!

It's sort of old news but this horrendous piece of poo poo has just started to bite. There is a 25 year sentence possible for:

quote:

"If an Australian citizen enters a foreign country intending to engage in hostile activity on behalf of armed forces that are not part of the foreign government, they could be charged. They can also be charged for intentionally supporting these hostile activities. The type of support can include preparations by training or drilling, accumulating arms or giving money for goods that could be used to support incursions. It can also include giving money to people or associations that may be intending to engage in hostilities."

That would have meant that the people who fought Franco, like Hemingway and Orwell, would be subject to horrendously long jail terms if they were Australian. Ditto anyone who actually fought against apartheid, or in any one of a bunch of other actions against military dictatorships (Burma anyone?).

These laws happened on our watch.
