Here's the funny thing: the EPA is already all over this but they are playing it BLM vs Cliven Bundy long game style. There is no nationwide inspection program and if the EPA were to make it a priority to really crack down on it there is a large subgroup of people that would go do it just to stick it to the EPA. Instead the EPA is letting normal attrition take care of the problem because vehicles don't last forever and running a smoke tune is absolutely brutal on an engine. After they have ruined their current engine the jerks will go onto the market and find that all new trucks are equipped with a diesel particulate filter (DPF). And they will find that while the EPA was ignoring their smoke tuner they are cracking down hard on any company offering services or products which may be used to remove a DPF. Running a smoke tune with a DPF in place doesn't give them the effect they want. It instead looks more like you blew a head gasket while at the same time ruining/clogging the DPF in a matter of seconds. Oh and the DPF failing/clogging will cause the engine controller to go into limp mode giving you zero power until you go spend ~$3k for the replacement DPF which the OEM absolutely won't cover under warranty (they actually will void the entire powertrain and emissions warranty if they so much as suspect you've gotten a tuner anywhere near the truck). Finally the favorite loophole of the modified truck crowd is gone: non-road diesels are required to have the DPFs too. On the other hand the new diesels with the DPFs are much more powerful than the old ones ever were so hopefully soon smoke from the engine won't be seen as a sign of a powerful diesel but instead more along the lines of "whoa your truck has a serious problem, you might want to get that looked at".

Exactly. Last I heard the EPA went after one of the major makers of tuner kits which could be used for DPF deletion, confiscated their inventory, fined them to hell and back, and were working their way down the customer list demanding VIN numbers and proof that the kits were not installed on DPF equipped vehicles. Every other reputable tuner manufacturer has since stopped making such kits.
