Gays are free to impregnate women and raise children with their non-romantic heterosexual co-parent.

Also it is literally an argument made in that lovely Orson Scott Card essay.

That argument was rejected in Loving when it pointed out that the law didn't discriminate against blacks, since it applied equally to whites and non whites. They were both able to marry, so what's the problem?

This was not a compelling argument, mind you.

It distinguishes between male-female unions and all other pairings—not between heterosexual unions and other relationships. Indeed, Idaho law allows a gay man to marry a woman or a lesbian to marry a man."

Also included is an argument about how gay marriage just hasn't been a thing long enough to be legally acceptable and I CAN'T READ ANYMORE AAAAAAAAAHHHHHHHHHH

I have actually seen that argument made by marriage equality supporters. They say it's not discrimination against gays, since it doesn't matter if your are gay or straight, you both can marry a partner of the opposite sex. Instead, it's gender discrimination, since men can marry women but women can't, and women can marry men but men can't. And since gender is actually already established as a protected class, it follows that gay marriage bans are obviously unconstitutional.

I disagree. If anything, it doesn't promote lovely behaviour. It was always around. Now they just have a place to go and spew it with the false idea that no one will know. Except that's not how the internet works. If anything, it was created a situation where bigots voluntarily congregate in places they believe to be secret. Which the internet is very much not.

Idaho's governor gave up and dropped the appeal. Marriages start tomorrow.

ed: Judge Burgess denied Alaska's request for a stay, marriages continue there. They intend to appeal to the 9th Circuit, but judging how they've handled other states in their circuit it's unlikely they'd grant a stay either, let alone rule in favor of the ban.

In other North Carolina developments, Pasquotank County Magistrate Gary Littleton took the Liberty University approach to the law and refused to marry a same-sex couple on Monday because it went against his religious and moral beliefs. He could lose his job over it if the couple decide to file a complaint (they say they're not, since they already made their point). Littlejohn decided to skip out on the press, so his boss is stuck with the job of explaining his motivations.

WTKR News posted:

According to a memo sent from North Carolina’s Administrative Office of the Court sent to magistrates, their duty is to “immediately begin conducting all marriages,” whether the couple is gay or not.

But [Chief District Court Judge Christopher Bean] says that memo wasn’t sent out until after 5 p.m. Monday and says there was a lot of confusion as to what these magistrates could or could not do when performing same-sex marriage ceremonies, even though it became legal late Friday afternoon.

“Everything happened so fast,” Judge Bean said. “You’ve got to remember magistrates are not lawyers, they are just citizens who have been appointed. They don’t necessarily know how to interpret the law.”

NewsChannel 3 asked if Judge Bean really believed the magistrate didn’t understand his duties. He said “I don’t know, he did make the statement that he could not do that because of moral ground, so that would make me think that he had a question in his mind if he was properly performing his duties or not.”

What's frustrating about that Brian guy is that he's being so disingenuous. You can tell what opinion he has but he never quite talks about it: Being gay is a choice.

In addition he has this asinine view of the Constitution as a document to be interpreted literally, and all amendments aside from the 1st are to be interpreted literally and without additional opinion added. He just got mad when the other guy called him out on that by explaining how our government works.

I ended up stopping after the military guy called up and Brian got flustered and just went back to his talking points "I respect the military but stand up for marriage being between a man and a woman."

It's all that love the sinner, hate the sin crap. Makes me happy to know that courts are overwhelmingly rejecting this guy's argument.
