That argument was rejected in Loving when it pointed out that the law didn't discriminate against blacks, since it applied equally to whites and non whites. They were both able to marry, so what's the problem? This was not a compelling argument, mind you.

They say it's not discrimination against gays, since it doesn't matter if your are gay or straight, you both can marry a partner of the opposite sex. Instead, it's gender discrimination, since men can marry women but women can't, and women can marry men but men can't. And since gender is actually already established as a protected class, it follows that gay marriage bans are obviously unconstitutional.

Idaho's governor gave up and dropped the appeal. Marriages start tomorrow. ed: Judge Burgess denied Alaska's request for a stay, marriages continue there. They intend to appeal to the 9th Circuit, but judging how they've handled other states in their circuit it's unlikely they'd grant a stay either, let alone rule in favor of the ban. You can tell what opinion he has but he never quite talks about it: Being gay is a choice. In addition he has this asinine view of the Constitution as a document to be interpreted literally, and all amendments aside from the 1st are to be interpreted literally and without additional opinion added. He just got mad when the other guy called him out on that by explaining how our government works. I ended up stopping after the military guy called up and Brian got flustered and just went back to his talking points "I respect the military but stand up for marriage being between a man and a woman." It's all that love the sinner, hate the sin crap. Makes me happy to know that courts are overwhelmingly rejecting this guy's argument.

9th Circuit granted a very temporary stay in Alaska. Alaska has until 3 PM Eastern Friday to get a stay from the Supreme Court (reminder: Idaho couldn't get it done with more time available); if they don't, the stay ends and I believe that's that for their ban.
