It's a nice little catch-22 where they'll never get the margins for 'that sort of thing', because it'd be better to use the extra budget to expand, and so they will never compete fairly for employees. I can see where they twisted their logic into a pretzel (it's the part where they apparently consider fair competition for employees is abnormal) so I doubt they'll ever see the error of their ways (even when punished they'll just believe the laws are unreasonable, and therefore fight the law)

That still equates to extra cents a month to put toward Steam games even if the money I make back from spending does not physically get to me until a while later. I am an adult with a job, y'know. Of course, I don't expect to make very much money at all because lol why would I so really I just took the option because a) it's there and b) smart people use adblock so it won't bother anyone anyway. Regardless, I filed the claims under fair use because really that's the only option that kinda sorta sounded like a way to explain that the claims are fraudulent. So we'll see how it pans out.

I don't know; would it make people feel better if EA or Visceral was filing the claim instead? Because I doubt they really want you making money off their game as well, though I do agree that these rando frivolous claims are annoying. I remember one I got years ago from silent, semi-ambient noises in a Silent Hill game...but it was silent, semi-ambient noises from Akira Yamaoka.

I've gotten incorrect copyright flags before (Youtube's bots seem CONVINCED that the background music on Civilization 5 is some old song that sounds nothing like it.) I just file a counter claim explaining that it's not only fair use but also these folks don't own that song either and it was mistakenly flagged, it's worked out two or three times now.

My personal perspective on it is, making money off of my LPs is not so important to me that I'm willing to fight the company that made the game about it. If Visceral auto-IDs my video of Dead Space 3, I'll let them have it without a fight IF and only if there are no changes made to the video itself. If it's blocked in countries, or parts of it are silenced, or restrictions are made on my account, then I will be willing to argue about it.

People wouldn't like it, but publishers and developers at least have what would be perceived as a legitimate claim to that material. Even copyright trolls can at least claim to be standing on solid (if low) legal ground. In a just world, repeatedly filing bad faith claims against someone else would be charged as fraud, but there's no way to reliably prosecute the thronging hordes of idiots looking to make a quick buck off of youtube's lovely DMCA.

Heck, sometimes it's neat to see a legitimate copyright holder file a claim just to know that they're still out there and monitoring (via Youtube's automated system) the use of their material. The group that did the ending theme of Folklore filed a claim on their music and I went ahead and acknowledged it. Now if only Youtube gave me some easy way to look into more of their music, I might check them out. I should probably acknowledge the company that bought Ubisoft's early games, too - Ubisoft gave blanket permission to use games like Assassin's Creed and the more recent Rayman games in LP videos, as I understand it, but that probably doesn't include games that they sold the rights to prior to that declaration.

I meant more like "general" sounds. Google's Content ID Match thing is just an algorithm. It's not like lawyers comb all the sounds you're registering. There's counter-measures sure, but let's be honest: "Porn Music with Girl Making Noises" might be sound you happen to own... or it might not... or it might be sounds you own that are "close enough" to the Content ID Match to manage to catch other sounds in your registered net. I'd assume Google removes offenders when it finds them, but it's a pretty poor system and people have started abusing it.

Unless Let's Play is considered a substitute product for the actual games - which is subject of debate, but hear me out for a moment - it doesn't cut into profit one way or the other. That could change if Ubisoft enters the video production market, but if it's a totally separate market, it doesn't hurt Ubisoft. It's not like they're making that ad money, nor is it profit they're losing, unless it breaches their IP or something. You're spreading word of their game so they get free advertising. (This gets dicey when Activision removes videos that show off glitches in new games, and some companies do expressly forbid monetizing videos with their footage.) Some companies have actually now come out and said LP helps sales and they're all for it. And if monetization helps more LPers enter the market and spread word of their game, the more the merrier. Bigger game devs even invite LPers to corporate events or dole out review copies. They're all for it. Now as for, "are LPs substitute products" - yes I do think there's a share of market you potentially lose by letting people watch and potentially decide they don't want/need to buy - but right now the devs seem to be of the opinion that the new people brought in more than make up for it.
