I don't think ATL preference voting is open to a high court challenge, since it's not functionally different from a GVT. The current conclusion of the joint standing committee on electoral matters is optional preferencing with an above-the-line option, which we're probably going to get before 2016. Eliminating candidates based on % of the vote is really arbitrary, and still wouldn't stop people with 1.5% of the preferred vote from getting elected, which really isn't much more of an electoral mandate.
