I'd imagine a great deal is going to turn on the marks on Robin Bain's fingers, which were discovered after the retrial from memory. They were largely dismissed at the time by the Police so it will be interesting to see what weighting is given to them.

And speaking of "evidence both ways," I've wondered if people in the legal profession feel that his retrial a few years ago where he was found "not guilty" was, in fact, a fair trial? I remember feeling sceptical of the possibility at the time due to the amount of literature relating to the Bain case that had been published and the frequent coverage that it got from time to time, not to mention that pretty much everyone had a firm belief in his guilt or innocence.

Martin Van Beynen's account of the second trial is regarded as the best explanation for what happened.

quote:

The verdict surprised me, but should not have. If the case had been put to 10 juries, I believe six would have convicted, two would have acquitted and two would have been unable to reach a decision. Bain won the lottery.

Several aspects about this jury should worry us all.

The two jurors - a man and a woman - who were seen to congratulate Bain after the verdicts and who went to his celebratory party were the same two who spent the last three weeks of the trial paying little attention to the evidence and closing addresses. They giggled and wrote messages to each other.

The man would often sleep through parts of the afternoon.

Initially, the woman was so disturbed by the images shown as evidence that she turned her computer screen away. By her own admission, she spent the first two weeks of the trial in tears, and the trial lost half a day because of her anguish.

Another juror, known to another member of the media covering the trial, had a serious question mark over her ability to follow the evidence. Yet another went to congratulate Bain's legal counsel after the verdict.

I remember hearing about the two jurors turning up to Bain's party after the trial, but gently caress me, that's even worse.

That really worried me as well. There's definitely issues with the jury system, and retrials like Bain's are a perfect demonstration of some of the faults in that system. Still, there was reasonable doubt at the second trial I think. Probably. Hard to be certain without being in the courtroom for the whole trial.

The first trial I was still a kid during, and although I read up on it later, by then all the coverage was pretty biased one way or another so not sure if it was the correct outcome at that time or not. The Karam book I remember gave me nightmares - it had colour photos of two of the victims post-death.

Running a party well means not allowing MPs to attend events celebrating people that they happen to think should have less human rights than others. Not sure what Alfred Ngaro was trying to achieve there, he's supposed to be building his profile in West Auckland. But it's something that should have been communicated from the party - or at least Nikki Kaye should have pulled them up on it. It reflects kind of badly on her for not doing so tbh.

If they are going to turn around and say "Yea, we were wrong about the marriage amendment legislation, it's a good thing and we should have voted for it" then there's no real problem with them going. But otherwise it's incredibly transparent.

E: Also, ATM vandalised in Ponsonby was by a group who wanted to protest against pink washing.

Shouldn't the queer community be allowed to have a pride parade that is a safe space? This angry 6-foot plus protestor jumping the barriers before screaming and fighting with security left many participants literally shaking.

Hope these idiots are prosecuted.

Alfred Ngaro's the guy who allegedly hit a school teacher for not praying, so I doubt he just voted against on behalf of his constituency. The GayTM thing is so dumb, they chose the lightest-possible shade of pink & relied on a single poster to explain (which either fell on the ground or was concealed by ANZ).
