I'm reminded of the various cases in the 1980s where concerns parents were alarmed with the rise of metal and the argument that came back from one of the bands was basically "Why the hell would we knowingly want our fans to kill themselves?"

An Iranian refugee couple has been taken to hospital after being pelted with rocks and knocked off their motorbike on Nauru on Monday night.

The man and his wife were riding past the Menon Hotel in the capital Yaren about 10pm when local men began throwing rocks at them, sources on the island said.

At least one large rock hit the man in the face, knocking him and his wife from the bike. Onlookers found him unconscious on the road, bleeding from a large gash on his face.

The couple has been found to be refugees and has been settled in the Nauruan community.

They were taken to hospital, where the man regained consciousness and was able to speak to other refugees.

The attack is the latest in a string of assaults. Asylum seekers and refugees, sent by Australia to Nauru to be resettled on the island, have reported rising hostility.

A series of street demonstrations held by refugees and asylum seekers this month, protesting against Australian government policies and conditions on Nauru, further inflamed tensions.

Video footage taken during one of the protests showed a Nauruan man, not in any uniform, walking from behind a line of police to punch a refugee who was filming the protests.

Fairfax have already mooted a High Court challenge should they fail in the case, no doubt prompting McClintocks feverish performance today. Collins has apparently stated in his written submission that qualified privilege has had a bad run in appellate court, and this is a problem should they wish to fight an appeal. I was unaware that a Federal Court judge couldn't overturn an NSW Appeals court decision, which is being suggested here?!

I've spent half an hour typing something about how this fits with the Constitution, Judiciary Act, specific court legislation and the common law, and it's still about as clear as diarrhoea, so here goes my simple version:

- The Federal Court is hearing the case because maybe Fairfax is using the implied constitutional freedom for political communication, maybe?
- Defamation is usually a state matter, so the single federal judge is in the position of a first instance NSW judge, and thus bound by NSW appellate decisions.
- Judges at the same level aren't supposed to disagree unless one is obviously wrong. So two NSW single judges shouldn't overrule each other because they're the same court - the same thing applies across jurisdictions at the same level. This is because there is a single common law of Australia, and only the High Court tells everyone what that is.
- Because of that last principle, theoretically the Tasmanian Supreme Court could set some interesting precedents and the rest of Australia would have to follow. Ha!

Job Description: I perform onsite break fix and troubleshooting for National Companies like Fujitsu and RSS for customers ranging from Coles and Target to the ATO and Aurizon as well as in-office IT support for the company I work for directly and some printer maintenance for the same companies photocopier fleet.
Wage: $17.40/hr with $137.31/week (equates to $3.61 an hour for a total of $21.01/hr) FLAT car allowance and $0.32/km allowance
Allowances: I currently get paid a car allowance in a flat rate/week as well as a rate/kilometer of business travel.

From my cursory lookings I THINK that I am under the MA000021: Business Equipment Award 2010. I currently do not have a copy of my contract though I will be trying to get one, and I don't know if there are any clauses in my contract that exclude me from awards etc or specifically what award my contract is covering me with.

The ideal outcome for me would be that I would be taken off the car allowance and brought into line with the other technicians in the workshop ($25/hr) and I am fine with still using my car for the work. I currently do not have the solid information at my disposal to propose this to my boss, who is a very tight individual when it comes to money and wages.

I am almost certain everyone working here is getting ripped off when it comes to OT and other things in the contracts. I would also like some information RE, who to turn to should he turn me down, as there are very few available jobs in Mackay in this industry and I am unable to move from here for the foreseeable future.

wow. I was getting paid ~$17/hour to do CPE repairs under the SA version of that award back in 2002-ish, and 56 cents per KM mileage. Can't recall the on-call allowance but it wasn't bad at the time.

That award should cover printer techs, see Part 1 section 4 here: http://www.fwc.gov.au/documents/documents/modern_awards/pdf/MA000021.pdf

If you're a field tech, working independently, then you shouild be at least technician level 3 and probably 4. Part 4 covers wages, and it looks like your mileage should be 78 cents per KM.
