I remember when you could smell the chemicals in the St Johns River from 30 miles away. Even in a breezy place like Florida, you could see the column of smog rising up above the cities. Trash littered the roadways.

Today, none of that exists (except for cigarette butts that litter the roadway). The river is blue and clean. They sky is smog free (over Florida, at least).

And there are TWICE as many people living here as there were then. Our cars actually have more horsepower on the average than they did in the muscle car era of the late 60s. We use a lot more electricity and water per capita than we did in those days.

Yet, we do it cleaner because we care for the creation. We didn’t have to do it. No foreign power made the USA create the EPA to clean up our environment. We did it for the same reason that we fought a war to end slavery—because it was right.

But the Civil War accomplished the mission and so did the EPA. It doesn’t need to bankrupt our nation just to justify its existence, and Pope Che doesn’t have to make us think that WWJD means living in tents and eating 2000 calories a day.

Oh, then here: http://www.theatlantic.com/health/archive/2011/08/why-does-the-fda-recommend-2-000-calories-per-day/243092/

quote:

The FDA wanted consumers to be able to compare the amounts of saturated fat and sodium to the maximum amounts recommended for a day's intake--the Daily Values. Because the allowable limits would vary according to the number of calories consumed, the FDA needed benchmarks for average calorie consumption, even though calorie requirements vary according to body size and other individual characteristics.

From USDA food consumption surveys of that era, the FDA knew that women typically reported consuming 1,600 to 2,200 calories a day, men 2,000 to 3,000, and children 1,800 to 2,500. But stating ranges on food labels would take up too much space and did not seem particularly helpful. The FDA proposed using a single standard of daily calorie intake--2,350 calories per day, based on USDA survey data. The agency requested public comments on this proposal and on alternative figures: 2,000, 2,300, and 2,400 calories per day.

Despite the observable fact that 2,350 calories per day is below the average requirements for either men or women obtained from doubly labeled water experiments, most of the people who responded to the comments judged the proposed benchmark too high. Nutrition educators worried that it would encourage overconsumption, be irrelevant to women who consume fewer calories, and permit overstatement of acceptable levels of "eat less" nutrients such as saturated fat and sodium. Instead, they proposed 2,000 calories as:

-consistent with widely used food plans
-close to the calorie requirements for postmenopausal women, the population group most prone to weight gain
-a reasonably rounded-down value from 2,350 calories
-easier to use than 2,350 and, therefore, a better tool for nutrition education

Whether a rounding down of nearly 20 percent is reasonable or not, the FDA ultimately viewed these arguments as persuasive. It agreed that 2,000 calories per day would be more likely to make it clear that people needed to tailor dietary recommendations to their own diets. The FDA wanted people to understand that they must adjust calorie intake according to age, sex, activity, and life stage. It addressed the adjustment problem by requiring the percent Daily Value footnote on food labels for diets of 2,000 and 2,500 calories per day, the range of average values reported in dietary intake surveys.

The debates themselves were just a sideshow, simply a vehicle for her to put herself in front of 25 million viewers.
I don't even think it mattered to her that Trump was her target that night. If Trump was not participating, no doubt she would go after one of the other candidates just as ferociously. Perhaps she would have had some "gotcha" zingers ready for Ted Cruz or Chris Christie.

Let’s see.

We gave the Republicans the House and they reneged on their promises.

Then we gave them the senate and they reneged on their promises.

Now they want the presidency and they will assuredly reneg on their promises.

They will do nothing about illegal immigration, nothing about defunding Obamacare or Planned Parenthood, nothing about Obama’s illegal amnesty, nothing about the economy, nothing about TPA,TPP, and nothing about blocking the Iran deal.

And for that we need to come into the Republican party on their terms.

They have so screwed us that it does not matter whom we vote for Trump or another dwarf. They have created this mess because of their actions.

And while we are on the subject of Hillary it turns out that one of Hillary’s biggest contributors is Foxnews. So knowing this we are supposed to come to Megyn’s rescue because she in essence is shilling for Hillary by way of Rupert Murdoch.

Yep! These are real convincing arguments for coming back to the Republicans.

So therefore we will apply heavy doses of the Trumpster for their viewing displeasure. Throw in a little Cruz for the coupe-de-gras and let them squirm from overexposure. We’re pro-choice aborting these feckless elitists in the GOPe without taxpayer funds.

George Will and most GOP elites prefer to retain control of the party even if it means losing the presidency again. They do not understand yet;as many of our own people, that we no longer have a two party system in America. Our body politic is reorienting and doing so rapidly. 2016 may be the year that finally we have become Conservatives first and are through rescuing the Republican elite from themselves; that our principles and our votes are not for sale,as theirs have been for years. From now on we are no longer their despised party base to abuse, humiliate, then expect us to vote for another Rino loser. This time we have come to fight. Our votes will now come dearly for our own passionately held beliefs;and not their cherished power and empty promises. If we must make Trump nominee to break through this shell of arrogonance, then so be it Mr. Will

I think it is time for An All Out War on the RINO GOPe / RNC / U.S Chamber of Commerce (The CABAL) that think they own and run every aspect of the Republican Party and can run roughshod over us.

George Will just made it PAINFULLY obvious the truth of the matter than many of us have been talking about for years. It is no longer supposition ... The Plain Truth is Out... We Conservatives thought of as mere Subjects - Peasants - Peons to the RINO Aristocracy. And are given no more credence than a doormat.

The RINO CABAL has to suffer painful defeat so we must fight them at every turn or they will continue to subjugate us as vote slaves.

First - every action that the RINO CABAL takes to lessen our influence, every word they speak about us in shallow regard to us, every time they DICTATE to us... We rise up in coordinated numbers to strike back ... fill their mailboxes with vitriol - venom that we feel to force them to understand the Hornet’s Nest they have poked a stick into.

I propose a pinned post here on FR Entitled Fight Back Against the RINO CABAL... In that running thread... FR members post latest Cabal Transgressions - their latest outrages and insults and most importantly their latest attempts to grab power and use underhanded actions to harm Conservative Candidates. It needs to be in one place along with telephone numbers, email address, Facebook Pages, websites ... Members could them post relevant information and A CALL TO ACTION... to send thousands of email, comment postings, faxes and phone calls to let them know - that a War has Begun...

I hope others see the good sense in this approach.

The GOPe is no longer a opposition party, it is just another wing of the Socialist party. I do not think the elite members really care if a Democrat or a Republican wins the election as long as that person believes in big government and open borders.

I will go further and state I do not believe the elite really care about any of the social issues they are using to divide our nation. Whatever works, they support.

True the Democrats claim to believe one thing and the GOPe claim to believe in another, but their action puts a lie to their beliefs.

The Republican party had been given a mandate to stop or at least slow down Obama’s policies, yet nothing is done.

We have Hillary Clinton that has broken more laws then the average mobster, and yet, the GOPe is silent. Why? Because she is one of them. And “them” is anyone not a us.

This nation is like a pressure cooker where the safety valve has been disabled. Middle America has no voice. Every institution seems to have been corrupted by the lure of more taxpayer money, and anyone that disagrees is given a label; racist, sexiest, homophobic, crazy and so on.

Calling people names does not win the argument, it does shut them up. But for how long?

The left always claims there is a war against one group or another, and in this they may have something. However, the elite in this nation is at war with the average law abiding citizens those that just want to be left alone, earn a living and raise their families with the fewest contacts with big government as possible. But they wont let us.

I do not think it is racist for the woman to have asked for a white person. Just like I don’t think it is racist to PUSH BACK on the plan by HUD to put people based on color into neighborhoods that they could not afford to be in.

I do not think it was right for her information to be leaked
out.

By some estimates, approximately 90% of all violent crime in America is perpetrated by black people.

That means for many people, just about all crime is black crime.

Could this lady have previously experienced the vibrant diversity offered by that demographic, and simply preferred not to interact with that community out of fear for her life and well being?

If so that’s her right. Rather than framing it as a horrific hate crime by a hateful, racist person, maybe the truth is she did not want to be raped and murdered.

Sorry that it’s devolved to this, but simply allowing people into your home is not safe nowadays.

But, it actually isn't that strange of a belief. Even after the Bill of Rights, states like Massachusetts and Connecticut both kept state Churches. It was only relatively recently that, both through the doctrine of incorporation (1925) and through the specific incorporation of the establishment clause (1947) that it was understood that the states were bound by the establishment clause. I am not making the claim that they are correct in this interpretation, but the idea that the establishment clause does apply to the states is very new.

Also, that isn't what original intent means. Original intent is the belief that when determining law, the central factor is what the original meaning of the law was at the time the law was drafted, not any other factors (e.g. such as public policy concerns, concerns for consequences, or even concerns for previous cases). That the 14th amendment came after the first, does not mean that the first is superior to the fourteenth from an originalist perspective. The question would be whether the original meaning of the 14 amendment at the time of drafting would be that the states would be banned from establishing a church. Normally, the standard is either would a reasonable person living in the time and reading the law interpret it that way or what exactly did the law makers intend when drafting and passing the law.

Now, we can say that that is ridiculous for many reasons. E.g. Could two different reasonable people look at a document and come to different conclusions? Can we ever know what the original intent of the law makers were? Even if we could, it seems that original intent arguments often lead to bad public policy outcomes, which we would want to avoid. To what extent should legal history play a role in understanding original intent? If judges have favored one interpretation for a long time, can we say that they were always wrong to favor those interpretations? Etc. But, the idea that older parts of the Constitution are more important than later parts is not at all bundled up with the originalism.

Originalism is not a real judicial philosophy though it's just an adaptable smokescreen for whatever crazy thing the federalist society and its patrons want on a given day.

Falstaff Infection
Oct 1, 2014
Also wtf are you smoking with this "originalism gives equal shrift to all amendments" nonsense? Maybe in some fantasy platonic ideal world that's the case, but actually existing orginalists hate the Civil War Amendments and do everything in their power to interpret them as narrowly as possible because, again, the point of the philosophy is to advance right-wing causes with pseudo-historical nonsense reasoning.

Hugo Black was maybe the only honest originalist.
