Maybe in some fantasy platonic ideal world that's the case, but actually existing orginalists hate the Civil War Amendments and do everything in their power to interpret them as narrowly as possible because, again, the point of the philosophy is to advance right-wing causes with pseudo-historical nonsense reasoning.
