Well they didn't seem to care about a whole bunch of other fan movies - though maybe this is the first one with a big enough budget for CBS/Paramount to actually receive a decent amount in damages?

Furthermore, what about the knock-on positive affect to Trek (and thus revenue for CBS/Paramount) as a whole that a successful fan-film, professionally done, could have?

I know I said this in the other thread (I am at post factor 10 and currently occupy all star trek threads at once) but at this point big IPs like Star Trek and Wars and Superman and Mickey Mouse should be public domain by now, they're cultural icons and anybody should be able to offer whatever version of them they can think of, even if it's total crap. e: I mean most fan productions are really awful, but I'm glad the Axanar people are apparently going to try to fight this. Star Trek Continues has also been pretty entertaining and I think it would suck if they had to stop doing that too just because CBS wants to cash in on the nerdstalgia.

Also isn't the Xerox/Kleenex/Photoshop issue at play here? Where if you don't bother to defend a trademark and it can be shown to be generic enough that "Star Trek" could just be like a generic term, like "watch this star trek jimmy, its got lusty spacemen in it". You could easily show that Paramount didn't bother to defend it against several other fan films.

Maybe I'm just imagining this, but I seem to remember someone talking about how they worked in the entertainment industry about 10 or so years ago when the internet video content was becoming pretty big and traditional movies/TV were being criticized for not being as fresh and interesting as these young upstarts who were doing it all on a fraction of the budget.

They sort of went on to explain that a lot of these new internet folks, though, were sort of getting a HUGE pass in the legal side of things at the time. I think they spoke about how much time and money traditional media spent just to deal with lawyers, filming permits, music licensing, contracts, insurance, guilds, etc. that internet talent was just ignoring.

True, but it's only due to the fuckery of companies like Disney that works are copyrighted for 50 years after death in the first place.

I used to worry about franchises I enjoy turning to poo poo once they became public domain, but after the Star Wars prequels, the new Trek movies and just about every rock band ever letting people use their songs to sell cars/food/etc. I can't really say that something like Renegades is any more unpleasant.

To be honest I never commented on it in this thread because it's loving dumb. Not only is every fan made star trek thing utter trash, somehow managing to be even more cringe worthy than the terrible movies they release, but it's obvious they aren't going to win a court case.

Maybe, just maybe, if they had filmed it on a home video recorder and it was clearly lovely and made as a hobby for free and no money was being made they may get away with it.

I just finished the first season of TOS which I have actually never watched beyond bits and pieces. I'm amazed at how many times they make the same Spock joke in just a single season. I'd say at least six times an episode has ended with him saying "why thank you Captain!" after being compared to a computer, or going "there is no need to insult me!" when they say he's acting human. The writers really love that joke.

Good show though. I'm surprised at how well it holds up.

Good show though. I'm surprised at how well it holds up.

The first season of TOS is really good because conceptually, they really were going where no man had gone before. They didn't have an especially clear idea of what the show would be about and you get to see it developing itself before your very eyes. Then, in true Star Trek form, they spend half the season fighting the god like energy being of the week and trading racist zingers about Spock while he's standing right there. Some great episodes though. It's all downhill from there really.

Also if a franchise just becomes really bad it should be made public domain. "You had your shot, you've ruined your own IP". Basically after Nemesis the entire trek franchise should have been pronounced dead and it's vacuum desiccated corpse given away to interested parties. JJ could have made his poo poo awful movies still, but anyone else could have as well!

And then Netflix would fund a Netflix exclusive TV series and you would think it was awesome and star trek fans would swarm to pay Netflix for a monthly subscription and Netflix would never need to release their material anywhere as it's all held centrally and digitally by them.

An Alien show that never showed the Alien would be kind of novel, but I think I'd rather do a long-form Alien story.

Ten episodes, pace it like an HP Lovecraft book, with a slow burn with a rapid rush to a gruesome finish. Set it in a single location, maybe a research lab, and most of the action comes from impersonal reports delivered to the main characters, who are researching different parts of the Alien creature but are not allowed to share data with each other, so they never realize what exactly they are researching.

Isolation and the rigors of their work lead to psychological breakdowns and it could end with one main character watching the security doors open up and releasing the research specimens, and he doesn't know if he's hallucinating or not as swarms of blurry alien silhouettes rush towards him.

I always had a soft spot for Quark though, because it was good to have a main cast member who didn't buy into Federation ideology in the slightest.
