Not to mention that Democrats anywhere who took over a city or state could move to ban firearms.

And look at recent moves by states like CT. The fact that they haven't gone around confiscating scary looking guns they banned doesn't mean it's OK to make criminals out of law abiding citizens by arbitrarily banning firearms they own.

Decision is also non-binding, IIRC, which makes it in the country's best interest to get a 9th appointed sooner rather than later since lower court splits will cause a ton of issues.

Roberts got poo poo on a ton for the ACA ruling and I can't imagine him being ok with the SCOTUS being used as a political football for the next year and making the judiciary suffer. Noted non-political decision, Bush v. Gore, where the conservative decision was basically "it's unfair to let votes be recounted, also this is totally a non-binding one-off thing that doesn't count in the future because reasons."

Or when the conservatives gutted the VRA and then the next day were on the losing end of a decision and Scalia cried about the exact thing he crowed about with the earlier decision. I know you're a gimmick and not actually this stupid, but come on guy.

Lindsay Graham's running around all the news channels declaring that he's going to block any Obama appointee who isn't "someone like Orin Hatch" because Obama and the Democrats broke the rules or something. He was kind of rambling. He also said he'd appoint a "qualified liberal" if Hillary is president but not if Obama is. The MSNBC tried to point out that this sound like a petty double standard but Lindsay wasn't giving.
