The way I'm reading this, and someone will correct me if I'm off base here, but Republicans already tend to turn out reliably. If this new development leads to obstruction in the Senate, even if Republican turnout increases it might also simultaneously seriously amp up Democratic GOTV efforts and if they move the turnout needle more than the GOP can (likely) this event will be a net gain for Democrats in a purely electoral sense. This doesn't even include the "gains" to be made from a lack of potential 5-4 splits.

If another Democratic president is elected and the current vacancy gets filled between Obama and the next person, there's a possibility of someone like Ginsburg dying during the term and her position being filled by someone with 30-40 years left in them. If my read is correct and Obama nominates a relatively centrist and well respected judge, the GOP might have to hold their nose and let it through or risk cutting themselves on the wires which are currently threatening to bind them.

It's going to be fascinating to watch however it unfolds though, that's for drat sure.

Ted Cruz is on the judiciary committee and he'll give exactly zero fucks about what anyone else says. If stonewalling Obama on this helps Ted then Ted's going to sabotage everything even if it costs the GOP the Senate. He is a King of the Ashes politician.

e: I'm more fearful that we'll get a center-right nominee because Obama will simply want to get a new justice confirmed rather than nominating a solid left or even center-left person who would be DOA in the Senate.

It could also mean that suddenly a whole lot of 5-4 conservative rulings get called in to question, or at least their results. We'd also potentially get the VRA un-hosed since a court with 5 left leaning justices is likely going to be hard to convince that why no, those red states aren't being racist or otherwise trying to cripple the voting power of their opponents, it just happens to be the result of... things.

So on one hand, a person died, and that is a sad thing. In all honestly, I found Obama's speech profoundly disrespectful, because he clearly didn't care enough to even fake caring about it, and it would have been better to not give a speech at all than to do him that dishonor on public television. Even discounting what you may think of the man, he had a family, and the knowledge that some people are actively celebrating his passing must be painful for them. As a fellow human being, Scalia is worthy of our respect, though not our admiration or agreement.

On the other hand...

I know her name was brought up already, but I think the right move for Obama would be to nominate Jane Kelly. She was appointed unanimously in 2013, the fastest appointment in Obama's term, with support from both Iowa senators, and Grassley is still the chairperson of the Judiciary committee, so he'd have to basically go back on his approval of her. Plus, she spent the 20 years before being an appeals judge as a public defender, which is something the higher courts don't really have.

I might be biased because she worked in Iowa for so long, but it would be pretty hard to find a reason not to nominate her save for a blatant political move, and that's what the Republicans are trying to avoid.

It's looking incredibly unlikely that any Obama nominee will make it through. Even if by some miracle a center-right justice was confirmed, that would still be an order of magnitude better than the Justice they would be replacing.
