The problem is that it actually is feasible for Apple to disable the security mechanisms the court is telling them to. Yes, the FBI will still have to brute force the PIN, but the search space is small enough that they should be able to accomplish that in a matter of days at most and more likely minutes - once Apple disables the security features that would prevent them from doing that. Since Apple controls the phone's firmware and it's possible to update the firmware on this particular model of the iPhone, it is entirely possible for Apple to comply with the court order. They're going to lose this battle in the end.

This is a derail in the making, but I don't think you could make any changes to the locked phones operating system or firmware because its, well, locked. And to brute force it, even if they could disable the timer/attempts security feature, are you imagining they have a robot arm that is pushing the buttons automatically at rapid speed?

The FBI wants to be able to brute force the phone. It currently has encrypted contents that are set to erase themselves after 10 unsuccessful attempts to gain entry. The courts want Apple to disable this feature.
