For that ST:TNG episode, it's more like they skipped way over the whole sexuality thing and went straight out to a real futuristic (for that era) concept: gender. Back then, it would be unheard of for someone not to be the gender they appear to be, beyond simply drag.

Scalia replied you need 3 justices to have a chief justice at least. To which King replied aren't there too many chiefs already. They had some fun guys.
