That's only because the site hosting these fan games, Game Jolt, is running an ad revenue sharing thing that essentially monetized all the games on there, including the Nintendo fan games, so they're well within their rights to take down games making money off their property without permission

It's kinda of crazy knowing the NX direct is probably already recorded, and journalists from major publications like Time have probably already seen it. (because they're real journalists and Nintendo knows they'll actually respect an NDA and not tease out rumors)
