The key difference, the filing states, is that Texas has stripped the word “reasonably."

“That standard is incorrect and far harsher than the Court-ordered standard it would displace,” the Justices Department argues. “By recasting the Court’s language, Texas has narrowed dramatically the scope of voters protected by the Court’s Order.”

Worth adding that this comes after at least a few Texas officials - including, of course, Ken Paxton - have said or heavily implied that voters could face charges if they can't prove they were incapable of obtaining one of the forms of ID required under SB 14.

a friend of mine runs a distillery and tourist trap outside oaxaca city (a little past the town with the big tree) and he gets coyote; he was able to sell it to tourists for about eighty bucks a bottle before the currency crashed a year or two ago. he'd go on a long salesman spiel about how it was mystical and the only agave that was mildly hallucinogenic but i never bought into it. that stuff was excellent but still doesn't beat the poo poo old farmers sell in plastic bottles on the side of the road

Highest and best use

A lawsuit pending in Harris County District Court in Houston filed by North Carolina-based Lowe’s Cos. against the Harris County Appraisal District is being closely watched by the rest of the state’s county appraisal districts. The lawsuit lists five stores that Lowe’s is attempting to have property values reduced. Lowe’s has a separate action pending in San Antonio using the dark-store argument, but it’s not as far along. It’s still in arbitration, said Bexar County deputy chief appraiser Mary Kieki. Lowe’s is challenging assigned property values of 10 open stores in the county for each of the last three years. The stores are currently valued at $82 a square foot. Lowe’s asked to reduce the valuation to $20 a square foot, she said. “This could be enormous,” Kieki said. “It wouldn’t stop with the big boxes like Sam’s, Lowe’s and Home Depot. You could see it continue with Kohl’s and CVS. Where does it stop?”

Heated topic
Texas is Lowe’s largest state with 141 stores. It’s also the largest state for Wal-Mart which has 600 stores here. Wal-Mart declined to comment on the dark-store strategy. A Target spokeswoman said the retailer had nothing to share on the topic. Big box retailers say a store’s market value should be set at the sale price of a similar size building that’s vacant. Retailers argue the large buildings, often well over 100,000 square feet, would be difficult to sell if empty, plus deed restrictions limit future uses. Appraisers say that’s an argument to make if a store is closed and the building stays empty without hopes of a new tenant coming in, but even then appraisers say that’s not a solid argument. “A closed store would be a case-by-case property issue,” said Collin County chief appraiser Bo Daffin. “It’s not a way to look at a category of all big box stores.” No retailer has presented Collin County with the dark-store strategy yet, Daffin said, but it’s making its way through Texas. “It’s a very heated topic,” Daffin said. “We’re not immune to this. It could come to Collin County if it’s in Bexar and Harris counties.” If an appraisal is wrong there’s a system to protest it, he said, but changing the way appraisals are calculated using a dark-store strategy is not the way Texas does it.

Limited litigation funds
The Dallas County Appraisal District doesn’t have any dark-store issues, said Cheryl Jordan, a spokeswoman for the district. Nearby Hunt County settled with Lowe’s over the 2014 valuation of a Lowe’s store in Greenville. “They used the dark-store strategy, but we didn’t go to trial,” said Brent South, Hunt County’s chief appraiser. The legal costs associated with taking the case to court would have been too high for a county with an annual litigation budget of $50,000, he said. “We didn’t have the resources to go to trial.” Hunt County settled for a valuation that reduced Lowe’s property taxes by about $23,000 a year. South, who is a past president of the Texas Association of Appraisal Districts, said he believes in Texas the deck is stacked against the counties because if it loses in court, the county must pay the retailer’s attorney fees and 9.5 percent interest on the refunded taxes. “In the end, it’s very costly to the homeowners because we have to shift the tax burden to them,” South said.

Routinely protest
"Just like homeowners, we want to be taxed fairly on the value of our buildings and land,” said Lowe’s spokeswoman Karen Cobb. Lowe’s said its stores generate jobs, pay state and local income tax, sales tax and property tax, and every year it routinely reviews property values assigned by county tax assessors to all 1,725 Lowe’s stores across the nation, she said. Cobb didn’t directly address the dark-store strategy. “Determining market value can be a complicated process, but in general, we look at information about comparable property in the area to help determine an appropriate value,” Cobb said. “In many cases, independent appraisers help us determine an appropriate market value for our buildings and land.” Disputing a taxable value, said Home Depot spokesman Stephen Holmes, is a common practice for any business that has physical taxable property when it believes its assessment is too high. Home Depot didn't use the dark-store strategy in Bexar County, which lowered the company's valuation of its stores from $82 a square foot to $65. Other states While Lowe’s seems to be leading the use of the dark-store strategy in Texas, according to appraisal districts, other big box retailers, including Home Depot and Target, have used the strategy elsewhere. Michigan has been among the states hit hard by the practice as Home Depot, Lowe’s, Target and other big box stores have been able to get property appraisals cut by as much as 50 percent. Counties stand to lose millions of dollars if the dark-store method of assessing big-box stores continues to spread, according to the National Association of Counties. The county group cited a report that said in Michigan alone, store assessments have been reduced by $75 million. The dark-store strategy has also been used in Indiana, Florida, North Carolina and Alabama. In West Texas, Taylor County chief appraiser Gary Earnest heard Lowe’s dark-store argument last year on two locations in Abilene. The district settled instead of going to court. “We’re watching Bexar and Harris counties,” Earnest said. “If other big box retailers adopt this, it will create a waterfall of events.”

My mom's husband was on the city council for the small DFW suburb of Richland Hills about a decade or so ago. Sam's Club had pulled out of their location in that suburb and moved to another one, and had just left the building empty. It was a tough situation for the town, because the giant empty building on their one commercial street really prevented any kind of development from occurring. (Not to mention the loss of sales tax revenue.) Getting someone else to buy/lease the building was pretty much impossible because the only businesses at all interested in it (or capable of spending that much on real estate) were Sam's Club competitors that Sam's refused to sell/lease to.

So yea, big box stores can gently caress cities over in a number of unexpected ways.
