It sounded a bit like that. Vancouver has legal basement suites, and that is an important part of the rental supply, so it'll be interesting to see if the city designs their policy to try to ensure that those sort of units are used for long term rental. Some sort of max amount of Airbnb rentals in a year (eg 90 days) would be something I could see them doing.

My feeling is that this policy will most strongly target commercial operators that buy a number of condos to continuously rent out on Airbnb. Someone's basement suite is a bit closer in concept to home-sharing, but I could see the city targeting this as well.

I posted this in the tech bubble thread a few days ago, but apparently there are no condo insurances that will cover short term rentals, so all the property managers are recommending to their stratas that short term rentals be banned anyway. It's hard to say how effective those bans will be, depends on the strata.

Anyway none of this seems like good news for Airbnb. There have been studies on Airbnb that suggest that the commercial operators that Vancouver is most likely to aggressively target comprise the massive majority of Airbnb's revenue.

I'd be very surprised if it affected long-term rentals of any kind.

Some sort of cap on number of days of rental per year seems unfeasible to me unless Airbnb is helping the city and capping it themselves. I haven't really paid much attention, but it seemed last time I looked that Berlin's approach of threatening $100k fines created a big drop in Airbnb listings.

I do think people overestimate the amount of long term rentals that are being lost with regard to detached homes and basement suites. A lot of these spaces are marginal and while they may be ok for a short term guest, they may not be that suitable for a long term tenant.

He does favour a tax, but says the provincial government went about it all wrong. “I’m not surprised. I think that the implementation of the tax was not done correctly,” says Saretsky. “Ultimately the 15 per cent tax is a good thing, but I think the BC government didn’t really think it through entirely in terms of implementation. I think the deal should have been grandfathered, and so, I’m not really surprised that they’re filing a lawsuit.”

The suit is not certified as class-action yet, but the legal action could eventually involve everyone who has had to pay the tax so far. It claims the province doesn’t have the authority to put such a levy in place and the issue falls under foreign trade, which is a federal jurisdiction.

The changes, which went into effect on Monday, will apply to people who sign up for a mortgage with Las Vegas-based Alterra Home Loans or Tustin, Calif.,-based New American Funding. The companies’ specialties include lending to low-income and Hispanic borrowers. The lenders will sell the mortgages they originate to Freddie Mac.

The partnership has been in the works since late last year and will be in effect for at least 12 months. Freddie Mac will determine whether to expand it beyond pilot phase if performance meets expectations. It declined to discuss any numbers it has as goals for loan volume or the delinquency level it would like to stay below.

The pilot isn’t lowering down payment or credit score requirements. Rather it is loosening income criteria, including for applicants who have two jobs. Until now, Freddie Mac has required that borrowers who show their income from a second job when applying for a mortgage demonstrate that they have held that job for at least 24 months, a period that in the pilot is reduced to 12 months. Separately, self-employed borrowers will have more options to prove their business exists to the lenders.

In addition, borrowers who will be living with family or other individuals for at least 12 months after they purchase the home will be able to use those non-borrowers’ income to get approved for the mortgage. The income will be factored in to help improve the borrowers’ debt to income ratio, a key figure that compares borrowers’ monthly debt obligations to their gross monthly income.

Paperwork requirements will also loosen up for some borrowers who don’t have bank statements to show how they have saved for their down payment.

Brasil said that under NAFTA Article 1139, ownership of real estate or other property is an investment that is protected by the NAFTA.

Brasil said the lawsuit it seeks to overturn the legislation and demands repayment of any tax added to the purchase price of a home because of the buyer’s nationality.

The civil suit filed Monday also claims that only the federal government has the exclusive power over the conduct and regulation of foreign trade.

“The legislature of British Columbia cannot enact legislation that is properly within the constitutional authority of the government of Canada, especially those in connection with the foreign affairs, aliens, international trade, and trade and commerce,” states the lawsuit.

It claims the tax was enacted without proper constitutional authority and is beyond the legal authority of the provincial government.

A judge must decide if the class action application can proceed and Brasil says it could take six months to a year to set a hearing date for the lawsuit.

On pause until 2019, TD predicts

An economist at TD Bank said he was inclined to agree with Poloz's statements.

"Population aging and slower productivity growth mean that the 'cruising speed' of the Canadian economy will continue to tick lower in coming years," said Brian DePratto.

He said TD believes the Bank of Canada is unlikely to increase interest rates until early 2019.
