I think if I was a cosplayer who got sued I would try very hard to imply I was dressing up as that character as a tribute to the character, not as a representative of the brand.

I'm not a lawyer obviously but I think this gets into some weird grey areas; you could claim derivative work or parody for some things.

Granted the other side of that is that licensed costumes of popular characters probably makes certain people a ton of money and they'd rather not risk shutting that cash cow down. Plus like was said it'd be a PR nightmare. The other side of it is don't professional cosplayers also sometimes get payed by the companies owning the characters to dress up like them? It'd a great promotional tool and is basically free advertising.

Even so I'd really, really never want to be that guy that does finally sue a cosplayer the first time.

See here's the thing.

Entity makes thing. Thing becomes popular. Entity makes money off of thing.

Other entities come along and see thing is popular. Entities, that number in the N range, see opportunity to make money off of entity that created thing.

Life time of entity preying upon * amount of cash made = dollar amount being taken from entity that created said thing.

Dollar amount * Number of entities using said thing = even more loving dollar amount.

Is "Even more loving dollar amount" >< amount to feed hungry lawyers to sue, lobby and prosecute, "Number of entities using said thing"

This is why there are very few if any lawsuits against cosplayers.

It's also great loving publicity to the brands that produced things.

People love these things, the corporations love these things.

This is one thing to the cosplayers, one thing to the share holders and one thing to the management.

Typically litigation over trade dress infringement happens in a business situation where one party copies the appearance of another party's product so as to pass off the merchandise as their own and sell it without a licensing agreement. A cash prize isn't a previously agreed-upon price for merchandise or a service, though. But being paid by a photographer to dress up as, say, Ariel or any other Disney princess, and then copying her appearance down to the color and style of dress/makeup/hair/shoes/etc would probably be construed as trade dress infringement on the part of the cosplayer. Or selling your hand-made costume that looks exactly like Wall-e - that's lawsuit territory, too, assuming you do it long enough and obviously enough for the IP owner to take notice.

A few months ago after posting my Artorias costume all over the internet, I made a friend in Italy who asked for some construction tips on his own artorias. Turns out that we both had the same project lined up next - Soul of Cinder from Dark Souls 3. Seems like he was a lot more industrious than me, I'm still sitting on a pile of uncut EVA foam and half-finished chainmail, while he's been putting in the work.
