Real people are even less tolerant of that kind of thing because you will never, ever know the intent as a third party observer, you just get to deal with your own emotions, and if a reasonable person could find the offending behavior offensive, than the intent isn't super relevant. Intent should matter in like, a courtroom environment. It honestly doesn't and shouldn't matter to laypeople who are hit by the shrapnel of offensive behavior.
