I think Hogan always maintained he was not being taped...but Heather knew it was happening. I good lawyer might have argued that Hogan, as a regular caller and listener of the show, should have known that Bubba taped Heather all the time and considered the fact that he could have been being taped. It would have meant someone listening to literally 10 years of bubba...from mid 90's power pig days until podcast-jones days and pulling all the tape that was relevant.

I don't think Hogan knew he was being recorded because some of his (non sexual) comments were very candid.
