govt lawyers argued that the EO didn't really do what it literally said it did, because of the magic "to the extent consistent with law" words that were inserted, and argued that this was just to highlight his tough stance on immigration

the court lol'd a bunch and quoted sessions and idiot piss-baby's words in the opinion

the govt argued that this dumb rear end EO didn't really mean anything and that there was never any intent to do what it said because they all knew it was unlawful

the judge just quoted bill o'reilly interviews and press conferences back at them

There are a few ways around this, including tying it to 2018 budgetary reconciliation if they really want to

however I would imagine that the senate will let it die on some procedural fuckery rather than having a vote if it actually gets through the house.
