it's not about discrimination. it's about my right to control my disclosure. it is extremely hosed up for someone else to out you without your permission, or to require outing yourself as a condition of employment. i don't really expect that to make sense to anyone here, but half the reason i need a new job is people at work were not being respectful and i had no control over my environment anymore.

Genuinely just curious, I'm wondering how a background check outs you? All I remember having to do for my background check for my current job is to consent to it and show up to the drug test. Is it that your old name shows up when they do it so you have to tell them beforehand?

it's this. to verify that i attended schools or had old jobs they need the name i had at that time because most of those places won't update your info in their records if you don't currently attend/work there. this means the background check form is fuckin' plastered with my deadname since i transitioned while in my current job. i contacted the company that does the checks to ask if the report they gave apple would just be the institutions + a note that they verified i went there and they told me that apple would get everything that was entered onto the form and that if i didn't disclose my deadname they'd just call me to get it when they contacted those institutions and add it to the form anyway.

so ya basically i am not allowed to just live my life as me and have a job. my trans status will define my relationship with my employer from day 1.

i probably shouldn't but i do assume that a workplace as large and put together as apple would isolate that information to HR without it crossing into hiring managers and team members. if not, that's very poor practice on their part.

for a slightly disingenuous e.g., (please note that sexual orientation and gender identity ARE NOT the same thing, i'm just being disingenuous), people would be fuckin mad if a background check form said "were you a homosexual at the time you attended this institution?" but because there's non-trans reasons to change your name it's really hard to get people to think critically about situations in which it might not be ok for name-change information to be transmitted in certain contexts.

That really sucks, Apple is a big company at least though right? Isn't it basically HR's job to keep issues like this private? Will they tell your former name and trans status to the team you'll actually be working with? Or will they just say "here is ur new coworker <cis autodrag>"

^^i assume they'll keep it private, but consider things like how if hr knows that im trans then people in hr may instantly make assumptions about what im doing if i, say, take fmla to have gender confirmation surgery. just by them knowing im trans they then later have the ability to deduce really private stuff that i wouldnt choose to share with them.

i would assume that too, but just the knowledge that people know can really interfere with your ability to just live your life. like i said, it's probably really hard to understand if you're not trans, but just the awareness that you don't really know who around you knows can be a pretty huge stressor. i'm only so open online because its pretty hard to put that cat back in the bag now. i didnt realize when i first transitioned just how violently some segments of the internet would react to it.

That blows maximum rear end and I hope that in some future socialist revolution we create laws that require employers and educational institutions to retroactively change names in records when requested for this very reason.

it would be easier to just regulate background checks at all so that they would just send verification and not whatever random details they used to do the verification. after all, it shouldn't be my responsibility to have to call every single place in the world that may have written my name down at any point just because i transitioned. it took over a year just to get the essential stuff like degrees, local utilities, mortgage, etc updated. my water bill still shows up with a typoed version of my deadname because the water utility is incompetent.

ultimately tho the problem is someone wants to know why your name changed and they might not realize its a sensitive topic until they discover why it changed.

Apple has 115,000 employees and every one has to get background checks. hr isn't going to remember a thing

fun story, here in wisconsin when you legally change your name you have to run an ad in your local paper for three weeks stating your old and new names and that you are changing it. i assume this has something to do with people in 1894 changing names to avoid debts but it's fuckin' onerous nowadays.

drug tests are loving bullshit. one of the lone good hr policies epic has is that they do not drug test, period. our vp laughed in a catholic hospital ceo's face when he asked if we would drug test staff we send on site.

not only is it invasive as gently caress (they ask for paystubs/W2s if they can verify employers, but technically everything they ask for is optional/requires your consent), its all outsourced to the philippines to the most robotic, process oriented drones imaginable

my background check got held up for weeks because a specific department that handles verifications for large companies using an automated process couldn't figure out how to do it or something

if you do business with the federal government they require you ensure your employees aren't banned from doing business with the government for reasons of terrorisms, medicare fraud, etc... if you fail to check this properly including aliases ur theoretically in deep poo poo if they find out.
