It seems like according to Burdick V. US, the pardon must be issued into a court of law. Doesn't that mean that there has to be court proceedings in process in order to introduce the pardon? That seems to make it appear that there is no such thing as a pre-emptive pardon since you cannot introduce the pardon until the the court proceedings begin (charges are presented). I think (and I could definitely be wrong her as I am not a constitutional lawyer) that means that Trump cannot pardon any of his staff or family or even himself until charges have been presented.
