Another example: If you want to get rid of the Electoral College, don't make the Interstate Compact an agreement for the electors to vote the popular vote winner, that will never get 50%+ of the EC on board. Rather, you should make it an agreement to legally bind electors to vote for the Democratic candidate no matter what. It's not technically unconstitutional, if the conservatives hate it they'll have to fix our dumbass system.

GreyjoyBastard posted:Hypothetical case, the GOP right now today does this in Texas or something. What happens? It works. But they're not going to do that. We should do it when we have power. Its such an absurd abuse of the system that the only reaction is to demand a change of the system itself. Or to copy the move tactically, but good luck with that when we can add however many senators we want at any moment. The goal, of course, would be to abolish the Senate.

Jesus, today, even as the GOP is trying to force an Obamacare repeal down the nation's throat despite such action having less than 20% approval rating, people are criticising Obama for being unable to appoint Garland. I don't know what's wrong with you, because God, Country, and the Second Amendment stood between Garland and the Scalia seat, even despite his more moderate jurisprudence than successful appointments Sotomoyer and Kagan. Obama's appointment notice was not going to be opened by the judicial committee, period, end of story. You cannot bully the Christian Right into yielding on this such that 60 senatorial votes could provide necessary override. This was never going to happen. Senators would have to have been threatened violently or assassinated for Garland to fill a SCOTUS seat.

Deteriorata posted:Even if Garland had been recess appointed somehow, his term would have expired in January, 2017 and the Republicans would have gotten to pick the seat anyway. And Trump would've been able to nominate for his vacant seat on the circuit court because Garland couldn't just magically take it back once his recess appointment lapsed. There's a lot of poo poo Obama should get but there was literally nothing he could do about Garland absent the one suggestion of granting federal pardons to people assassinating obstructing Senators.
