They've recently had more success, and came very close last year with the Friedrichs v CA teachers association in ending fair share dues for public sector unions. It only failed because Scalia died and we were supposed to be in the clear but gently caress brained morons the country over decided that not showing up to vote was alright because hey both parties are just the same who cares right? Anyways, there are more lawsuits set up to do the same thing because conservative groups like the Center for Individual Rights have an endless flow of cash to push them. Which made it even more important for democrats to win Scalia's seat but now I just getting angry and depressed so I'll end it there
