commentators seem cautiously optimistic Kennedy will vote against the gerrymander based on his conduct during oral argument

but it's kennedy so who knows

The same as when it was a Scalia court. Comes down to Kennedy as the split vote.

The court generally doesn't bother to hear cases unless it's planning to overturn them, and the current precedent says gerrymandering for purely partisan reasons is perfectly fine, you just can't do it for racial reasons.

So yeah it's gonna come out in favor of the GOP of course.

not really

the current language is:

quote:

(A) The term “ammunition” means ammunition or cartridge cases, primers, bullets, or propellent powder designed for use in any firearm.
(B) The term “armor piercing ammunition” means—
   (i) a projectile or projectile core which may be used in a handgun and which is constructed entirely (excluding the presence of traces of other substances) from one or a combination of tungsten alloys, steel, iron, brass, bronze, beryllium copper, or depleted uranium; or
(ii) a full jacketed projectile larger than .22 caliber designed and intended for use in a handgun and whose jacket has a weight of more than 25 percent of the total weight of the projectile.
(C) The term “armor piercing ammunition” does not include shotgun shot required by Federal or State environmental or game regulations for hunting purposes, a frangible projectile designed for target shooting, a projectile which the Attorney General finds is primarily intended to be used for sporting purposes, or any other projectile or projectile core which the Attorney General finds is intended to be used for industrial purposes, including a charge used in an oil and gas well perforating device.

the suggested language is:

quote:

(A) The term “ammunition” means ammunition or cartridge cases, primers, bullets, or propellent powder designed for use in any firearm.
(B) The term “armor piercing ammunition” means—
   (i) a projectile or projectile core which may be used is designed and intended by the manufacturer or importer for use in a handgun and which is constructed entirely (excluding the presence of traces of other substances) from one or a combination of tungsten alloys, steel, iron, brass, bronze, beryllium copper, or depleted uranium; or
(ii) a full jacketed projectile larger than .22 caliber designed and intended by the manufacturer or importer for use in a handgun and whose jacket has a weight of more than 25 percent of the total weight of the projectile.
(C) The term “armor piercing ammunition” does not include shotgun shot required by Federal or State environmental or game regulations for hunting purposes, a frangible projectile designed for target shooting, a projectile which the Attorney General finds is primarily intended to be used for sporting purposes is primarily intended by the manufacturer or importer to be used in a rifle or shotgun, a handgun projectile that is designed and intended by the manufacturer or importer to be used for hunting, recreational, or competitive shooting, or any other projectile or projectile core which the Attorney General finds is intended to be used for industrial purposes, including a charge used in an oil and gas well perforating device.

the law only ever intended to ban armor piercing ammo for handguns, but the way the law is phrased, a steel tipped rifle round would become retroactively illegal if someone somewhere develops a pistol that can shoot it. ak47 rounds fall under this, and those are mongo. so the change shifts it to only apply to stuff actually designed for handguns

the law already has huge problems because there's other ways to make an armor piercing handgun bullet than just switching material and there are end runs around it anyway by making like a tungsten alloy tipped lead round, but this change is not what people paint it as

Some court reporter today said he *thinks* there's five votes for tossing out partisan gerrymandering nationally. Kennedy has signaled he's just looking for the right case going back to a 2004(?) ruling, so this might just be it.

Video and press reports from the event show Trump tossing paper towels into the crowd. He is also seen handing out flashlights.
