You have to be a practicing attorney who has completed training, shadowed an existing GAL on two cases, and introduced yourself to the Judge in question to get on that list. The GAL is the one who acts as a kind of temporary attorney for the respondents (the old folks). Compiling the GAL report for the judge involves interviewing everyone: all the family, all the parties, everyone seeking to become a guardian, all the medical people, friends, neighbors... anyone who can provide useful information. The fees for this work are either paid by the State or the petitioner, not the old folks. After all that, the Judge weighs in. At least where I am, they take it as seriously as you would expect. In the vast majority of cases, the guardian ends up being a family member. The problem here is a "commissioner" who rubberstamps guardianships instead of acting like a proper GAL, in addition to this "Emergency Ex Parte" business I'm pretty sure isn't even possible here. 100% of the rules come from State statutes, which accounts for Nevada having a particularly lovely system.

They can sign a durable Power of Attorney appointing you or someone else full guardianship powers in the event they are adjudicated incapacitated. It's much easier that filing a petition after they go bonkers.
