that sort of horseshit is why i think every high school student should be required to take a class called "stupid human tricks" where they teach you the psychological and mathematical phenomena that underlie scams and confidence tricks, and how those concepts are exploited on a large scale it would be a really popular class bc everyone loves to learn how to trick people, and it would cover everything from "how credit card companies make money" to "what it means when a deal looks like you can't lose" e: i'd also stick in some of the opposite stuff -- "how tax brackets work, or why taxes SOUND like a scam but actually aren't" Sagebrush fucked around with this message at 04:46 on Oct 20, 2017 |

I’ve long thought that the whole concept of uber was to apply the techniques of retail sales to the labor force. loyalty programs, incentives, etc. basically make the whole idea of working so confusing that you can generate a lot of margin by making people think they’re getting a good deal it’s the GENUINE SWISS WATCH ORIGINALLY $1000 YOURS FOR ONLY $299 but for labor

FCKGW posted:so irl loot boxes, cool speaking of, am I wrong in thinking that the whole loot box trend is on thin ice legally? you pay money to buy a completely random chance at a prize which is worth money, perhaps more than you paid originally. in some cases the prize can even be sold for money-equivalents. it is gambling. it seems like the first time an AG or lawmaker has a kid that runs up a bill in Overwatch or Counterstrike the whole industry could be in for a reckoning.

I mean that I'm some cases (Valve) you can sell your prizes in a market run by the company for credit which is not even obfuscated by being "coins" or "gems" but is instead expressed in dollars. it can also be used in place of or in combination with actual dollars to buy various things.

I'm guessing with the Steam thing you can never actually get cash dollar back out the other end though, which is probably where their 'not gambling!' argument rests.

NoneMoreNegative posted:I'm guessing with the Steam thing you can never actually get cash dollar back out the other end though, which is probably where their 'not gambling!' argument rests. it doesn't matter, non-cash prizes are still prizes. much more clever people have tried that line of argument and have been shut down repeatedly by courts. there are three parts of the test for if something is gambling: 1. it requires payment of some form by the player 2. it is based on chance, and 3. winning gets the player something of value, either by directly giving the player a thing which has intrinsic value or causing the game operator to perform a service for the player which is a loss of money or revenue for the game operator. sweepstakes avoid being called gambling by not requiring payment to enter which avoids test 1. arcades get around being called gambling by making the ticket payout games skill based not random chance based which avoids test 2. some states count poker and card games (even video versions) as skill based games. test 3 is why a casino slot machine with tickets to attend an in-demand show at the casino as the prize would still be gambling - not selling that seat to a paying customer is a loss and thus has value. loot crates require payment by the player (both in time to obtain one and money to open it), are completely chance based at odds determined by the game maker, and give away items of value to the player and to the game maker (because in most cases the maker could easily sell the top item for cash in a market).

something like 90% of the tech bubel is using technology to find ways around legislation (or find areas where legislation hasnt caught up) and make money until the law shows up. labor laws (uber), consumer protection laws (kickstarter), gambling laws (loot crates), money laundering and drug distribution laws (bitcoin and silk road), etc etc

to be clear we're talking about in-game boxes of items that might contain something good but are probably poo poo, and not "loot crate" the mail service that sends you a box of overpriced poo poo they couldn't sell at hot topic every month, which i've only just realized should be called "funkobukuro", yeah? do strictly cosmetic, non-transferable game skins like the ones in overwatch count as items of value? they do absolutely nothing to give anyone any advantage in gameplay, and they can't be redeemed for anything, and also they're free to open unlike the poo poo csgo ones that buy loving keys at two, three bucks each to open a box with an EV of maybe 20 cents if you could sell the item on the in-game marketplace, which you aren't doing

flakeloaf posted:do strictly cosmetic, non-transferable game skins like the ones in overwatch count as items of value? whether it has a gameplay effect doesn't matter for the purposes of this argument. they probably would unambiguously count if blizzard gave you the option to put down some money and pick out the one you want from a list in addition to the random crates, but afaik they do not, you can only buy them with the tokens that came out of loot crates in the first place. all these systems have multiple layers of currency and value to muddy the waters around where exactly you have transmitted money to the company and where exactly the products are delivered in exchange haveblue fucked around with this message at 14:14 on Oct 20, 2017 |
