The ESRB already has to certify games in many cases. They can just add this to the list of elements that they have to certify for. It should be straightforward to eliminate most loopholes. Anything that requires paying real money for a random outcome would be bad. Any random outcome that can be obtained from a currency that can be converted into from real money would also be bad.
