Legally they're dead, inheritance proceeds, and cryonics is a very elaborate and expensive form of burial. I don't think they are presently, but the Cryonics Institute used to be legally registered as a cemetery. Cryonicists' big legal battle is to stop autopsies being conducted on the decaying flesh of their should-be-frozen friends, or at least their heads.

Thinking "I've got it all figured out" when you actually don't know poo poo is just how our brains work, it's the Socratic paradox that allows us to function. But they think they have transcended their own humanity, and they're practically defenseless against it. Anxiety, religious mania, sexual frustration, superstition, xenophobia, you name it, they are in its thrall in a deep and recursive way. They can divine the nature of the universe, but cannot eat a meal in public without experiencing some sort of emotional conflict or distress. So you tend to get some interesting but ultimately unsurprising results when it comes time for them to create a God in their own image. Replace god with government and your comparison holds up pretty well. What surprised me most about the first Roko's Basilisk discussions is that the common reaction was to try and prevent it, which seems to conflict with the "basically omniscient" aspect of it. Then again that was by order of Yudkowsky himself, because of course Yud can outsmart an omniscent AI. I figured it was only a matter of time before someone decided it was inevitable and threw humanity under the bus to try and save their own sorry rear end by evangelizing or inventing Original Sin, and I bet that has been discussed chez Musk.
