VictorianQueerLit posted:This is the current rock in a raging river backers are clinging onto for dear life. Semantics on what the engine is and how lumberyard invalidates the entire contract, instantly blowing up the death star. I'm not sure why any of that matters: 36. Section 2.1.2 of the GLA contained a critical promise from Defendants that they would not develop the Star Citizen video game using any other video game engines. 37. Section 2.1.2 of the GLA states that Defendants have a license only to "exclusively embed CryEngine in the Game." 38. On December 23, 2016, Defendants announced that they were using the Amazon Lumberyard video game engine for Star Citizen. The GLA did not permit Defendants to use any other video game engine in Star Citizen except for CryEngine. 39. Crytek has been damaged by Defendants' breach of Section 2.1.2 of the GLA, including for the reason that Crytek has failed to receive the benefit of the favorable attention that it otherwise would have derived from Defendants' use of CryEngine in Star Citizen

Well, as MoMA will be happy to point out, you don't have to honor your obligations, even if they're in a written legal contract. Honoring contractual obligations is tantamount to a cash grab furthermore quid pro quo e pluribus unum Unless, of course, your obligation was to give a few thousand dollars to a thief and a con man. That is an obligation you most definitely honor, and also a risk you know you're taking as a shrewd investor.

I kinda feel that Chris and Sandy deserve to ride off into the sunset with their millions. It's not like they forced all those idiots to hand over millions of dollars for a project that was obviously not going anywhere for years and laden with countless red flags burning as bright as an atom bomb. Will the citizens even learn anything from this fiasco? Probably not.

You know what else is crazy, "Squadron 42 doesn't exist" is something I kept hearing, so if CIG want to knock out the claims relating to developing SQ42 without a license they'd have to come right out and admit that it never did exist. In other words the only way they can prove they weren't developing SQ42 is by admitting in court they lied to backers to raise pre-sales for it. The whole thing is hosed, like if you haven't read the actual document yet please please please read it.

Bofast posted:So, if the "exclusively use CryEngine" part of the lawsuit is correct, they just admitted outright that they are in breach of contract? I mean, if they didn't switch, they may be liable for much greater damages for using Cryengine without the license, right? I imagine that's when you get into the profits and injunction parts of the claim, rather than just general damages for breach of contract. I could be totally mistaken on this though.
