Superhero stuff doesn't just have to be a 'celebration of vigilante justice' tho, and one thing nice about fiction is that things CAN be more idealized in it than they are in real life. Being 100% socially conscious and aware of everything terrible happening 24/7 is exhausting and reduces your ability to actually help people and effect change.

EDIT: Batman's got the set-up that it can totally be written as a white male power fantasy but at least even then he's got his no killing thing, and a lot of Batman continuities actually take into account the fact that crime is not just this disconnected thing that inevitably happens so we've got to punch criminals now.

Well and there's that whole 250,000 dollar cap for a lawsuit regarding a dead patient. If it can be argued that she is alive there is no cap on damages. Bigger payout if someone can just prove she's alive. Me? I think they're desecrating a corpse and prolonging the grief over years and years. No one will come out of this better.

Another way of looking at it is that, in a country where medical mistreatment and negligence of black people, women/girls, and black women/girls has always been, and still is, endemic, the hospital can save itself a shitload of cash if she's dead now

Yeah, if it's true and they fed her something causing this then the whole "she's still in there" thing they're doing makes a lot more sense because that way they didn't really kill their kid by accident. Would make a lot more sense for the entire family to rally around for that too.

I read some analyses and articles about the Tuskegee studies and Henrietta Lacks and the doctors in the study almost verbatim talked and acted like the doctor in that article. I actually had to reread the passage to make sure I was reading it right.

Yeah, making the most money out of a lawsuit has been the deciding factor in keeping this going on. They know she's isn't alive.

Eh. You're not necessarily wrong, but denial is a hell of a drug, especially if it's combined with guilt and a (perhaps wilful) ignorance or lack of education.

I mean it's possible the parents are just in it for the payout, but I think it's equally, if not more, plausible that the mother is just super in denial about her kid being dead, and is clinging to any hope she can. See also: the baby Faith thread.

The fact that a hospital can be sued for less if they actually kill someone rather than just maim them is disgusting to be honest. It highly insentivizes doctors to just give up in situations where they realize they've already hosed up. I mean if you think the parents are dragging this out unnecissarily for more cash, I'd wager it's just as likely if not more so that the hospital purposely killed her/rushed to get her declared dead once they realized they had hosed up.

Jahi's mom is not well, and if you've been following this story her actions can't really be explained by just greed.

Whether or not she was killed by accident by her family is not super relevant, but it does explain some of what's happened since. After Jahi was pronounced dead at the first hospital, I think the family ended up fighting that claim. They definitely moved her to a more religious state that would be more lenient in deciding just what exactly constituted death. They hired a lawyer for this and set her up in some kind of private care home.

Her mom is an absolute wreck, unsurprisingly. She loves dressing Jahi up and posting about how her girl is growing up and moving around and she's just about to wake up. Some of the pictures are pretty gross, the one in the article with her hand isn't even that bad. There are a few that show blood pooling in places and weird discoloration and she always looks very bloated. I'm not sure how religious Jahi's mom was before the ordeal but she's really counting on a miracle and for God to wake up.

Think about how bad this is for the other daughter. Either she knows her sister is dead and her mom is insane, or she believes her sister is alive and is going to have to lose her all over again and watch her mom spiral out of control.

So the New Yorker article has this passage, discussing long-term survival after legal death:

That refers to the case described in this paper. Which can be summarized as “though extensive medical intervention kept his heart beating, his brain literally mummified inside his skull over the course of 20 years”.

Did you read the New Yorker article? At least two very qualified, even by the estimation of outside people, neurologists suspect that she's not brain-dead, she's minimally conscious.

People keep repeating the "grandmother fed her a popsicle" story, but this hasn't been corroborated in actual news reporting. The New Yorker story instead documents that Jahi was having severe bleeding, severe enough that her grandmother the surgical nurse kept trying to get the post-op nurses to pay attention. That's documented in the medical records. If the popsicle story were true, you can bet the nurses would have charted it. After I read that article, I was ashamed. I'd bought into the "poor black family can't understand death" narrative, which is the hospital's story, and into rumors that made the family look worse.

Don't get me wrong; if it were me, I hope my husband would have pulled the plug. He knows this. But the article makes a well-researched point that the brain death standard we now use wasn't chosen based on science.

Yeah, the "cortical activity with a dead brain stem" scenario is so difficult, especially since we have no way of knowing the person's quality of life and because there's no hope for improvement. I personally would want to just be turned off if my brain stem cashed out, because that's the end as far as I'm concerned, but it's not a decision I'm confident in making for others.
