for the vehicle exception to work, someone has to actually be trying to get into the vehicle. it doesn't cover you from shooting from one car into another.

fla sta 776.013 Home protection; use or threatened use of deadly force; presumption of fear of death or great bodily harm. posted:

(2) A person is presumed to have held a reasonable fear of imminent peril of death or great bodily harm to himself or herself or another when using or threatening to use defensive force that is intended or likely to cause death or great bodily harm to another if:
(a) The person against whom the defensive force was used or threatened was in the process of unlawfully and forcefully entering, or had unlawfully and forcibly entered, a dwelling, residence, or occupied vehicle, or if that person had removed or was attempting to remove another against that person’s will from the dwelling, residence, or occupied vehicle; and
(b) The person who uses or threatens to use defensive force knew or had reason to believe that an unlawful and forcible entry or unlawful and forcible act was occurring or had occurred.

to break this down, in order to be covered by this statute you must have a reasonable fear of death or great bodily harm. you get a presumption of said fear, that is the prosecution must show the fear did not exist (this is possible in a number of ways), only in the ways covered by the statute. you must be first 1. lawfully in your home or vehicle (no criminal activity afoot - you don't get the presumption protecting your stash house from a raid by a rival gang), have someone attempting to break into your home or vehicle or have someone already unlawfully inside your home or vehicle (cannot be someone that was just there that you want out, either), and have knowledge that someone had broken in or was committing some other forcible act (forcible act is a term of art).

florida's presumption is broad and probably much broader than it should be, but it would not have protected dunn.

i snaked in a spot cause I was in a rush, carrying a bunch of gear and instruments on way to a show I was performing. the middle aged, balding man that I jilted lost it at me and tried to imply that he was going to fight me over it but I cussed him the gently caress out and pointed him to another spot a few up while insulting him. not usually the best move to escalate things but I read correctly that he was a spineless prick who would back down. idk your intentions guy, maybe learn to parallel park instead of sleeping in front of a spot
