My mother is a green card holder, she was arrested around 15 years due to a mixup at our local video rental place. They thought she rented a movie she didn't and filed a police report that issued a warrant for her arrest. It was deemed a felony since video tapes at the time cost the rental houses thousands of dollars. She didn't know anything about our justice system and had no legal representation so this mark is still on her record. I was a teenager at the time so I had no idea what to do either. My mother is now possibly going to be deported from the country she's called home for almost 40 years.

Nah, just some weirdo accounting thing where tapes made for video rental were cost way more than tapes made for consumers. Due to licensing issues and whatnot.

The most likely way to reconcile it is that ElCondemn doesn't have the whole story as it's very common for people to leave out details when relating these kinds of stories to their family.

That's not the important part, anyway. I don't care if their mother robbed the place at gunpoint. The important part is that it's absolutely ghoulish to reopen criminal convictions that are decades in the past and have been fully resolved in the justice system and tack on additional penalties. I don't care how awful the crime was (although if you read the LA Times article it's pretty clear they're going after long settled things that I would think everyone's notions of justice would agree should be left in the past).

Plus - deportation is a pretty loving foul criminal penalty in my opinion. It's wrong on every level to assess stricter criminal penalties on a subclass of people because of the location where they were born.

VCR tapes used to cost rental houses thousands of dollars, it was a licensing thing. I was around 14 or 15 at the time and was with her when they arrested her and took her to jail (we lived in the ghetto and cops would pull us over and hassle us constantly). I went to the video store myself to find out what was going on, I think the movie they said we rented out was Cruel Intentions (which as a religious household we would have never rented). There were a lot of minorities renting from that place and I suspect they were racist and did this to people who didn't speak english to get them deported. Fortunately my mother was a legal resident so she wasn't in danger of being deported at the time.

My mother didn't speak english very well at the time (still isn't great) so we basically talked to everyone for her, we were well aware of what was happening.

She was arrested and spent at least a day in jail where they stripped her and cavity searched her, which she told us while crying. It was all pretty traumatic for all of us, me and my brother had no family so we just fended for ourselves for however long it was that they kept her and they didn't even offer to help us. They didn't even give us a ride home that night, we had to walk all the way home since neither of us could legally drive. In the end she had time served and I think we had to pay the video rental place but maybe that was deferred or something since we didn't have money to pay what they claimed we owed them.

At the time I didn't know how hosed up the whole situation was, I just knew my mother was taken and we had no support or recourse, it was pretty scary. Now this is happening, so it's really the gift that keeps on giving...
