Apparently Donnie is so confident that the investigation has deadended that he's been openly badmouthing Mueller more than usual, and his legal representation isn't trying to stop him.

Narcissism is a helluva drug. It's only a matter of time before he rattles his brain enough to Etch-a-sketch the reality between his ears into him being a bigly hero man and doing it for the good of the people to prove how amazingly fantastic he is. I'm genuinely surprised it's gone this long. Either his kids are running the White House day care with their years of experience or his sycophants learned really well on the job.

More likely is the court would compel Manafort to talk under penalty of contempt if he refuses. This again, though, depends state by state and what the charges specifically may be. As it is now, Manafort himself has already had jeopardy attach to his federal crimes. If Trump pardoned him now, he would most likely be immune from state level prosecution for the same crimes. Different charges could be brought, and he may be compelled to speak about the stuff for which he was pardoned. Either way this is all a convoluted mess because no one has ever wielded the pardon power in such a blatant and bad faith manner. Most of the pardon jurisprudence we have comes from the early 19th century when Woodrow Wilson tried to force a reporter to accept a pardon so he could then compel him to reveal his sources. The SCOTUS held that a person has to unambiguously accept a pardon for it to apply.

If you had evidence of state level crimes and charged against those without needing Manaforts self testimony then the federal level pardon shouldn't matter. But the 'never been tested' and 'system is designed with good faith' issues are still there.

Vasudus posted:can a state charge an individual on a state level offense related to a crime they were federally pardoned for? or does that fall into jeopardy issues As a federal republic, the United States has multiple sovereigns; the states and the federal government. The states are fully sovereign in their boundaries. The only power the fed has is what the states themselves granted to the fed when the Constitution was signed / a state was admitted to the US. As sovereign, the states have full and separate authority to prosecute crimes within their boundaries. As a separate sovereign, the federal government also has separate authority to prosecute crimes, to the extent granted it by the Constitution. Separate sovereigns have separate rules of procedure and evidence, separate crimes, separate pardon authority and separate pardon rules. States can decide to try to make laws and rules match the fed or other states but aren't required to. The bill of rights (including the fifth) applies to the states through the 14th amendment, and establishes the minimum level of protection from self incrimination. States can give more rights than the fed Constitution, but not less. So: There is no constitutional double jeopardy between two separate sovereigns, like between a state and the federal government. However remember that states can grant additional rights over and above the federal constitutional minimums? States can grant greater double Jeopardy protections too. New York has such a law. New York can't dual prosecute if it's for "the same act or criminal transaction” unless it fits into a list of exceptions. The NYAG is trying to put in a fix but may run into some ex post facto issues wrt Manafort. Vasudus posted:would laugh if the nyag just charges manafort with all the crimes and uses his signed acceptance of the federal pardon as evidence Vasudus posted:but i dont think it works like that

They're definitely not going to force through important systemic changes. At best, if we get a real leftist/progressive minority, they'll push a few decent laws that help people. Most likely though they have another feckless/incremental stretch of power followed by an actual smart fascist. Donnie has primed the pump for fascism and if someone younger and less of a loving moron comes around then we'll go full autocrat in a heartbeat. If things go well it'll be because we run all the old fucks out of power, actual progressives rip the party reins away from the Democrats, and a huge chunk of the Boomers die off. Honestly just having a ton of Boomers die off would do wonders for the country.

Gen-X is just as bad if not worse than the Boomers, as they're more conservative on a whole. Most of your real shits in congress are Gen-X, and it'll only get worse as THEY get older.

Somewhere, some dickhead along the line changed all this generation stuff. Gen X used to be 70 - 79, and all of them were that 10 year period. Gen Y was 80 - 89, so on and so forth but then they changed that poo poo. So basically anyone after Gen X is a millennial now and Gen Y just disappeared, and then they changed Gen X to be a much wider range like 65-79 or something, and I'm pretty sure the reason was basically to group more people into convenient political groups. Millennials is now anyone conservatives don't like and Gen X is just a target for millennials because a bunch of older people are now lumped in there, and all this poo poo is really just meaningless now because the definitions change based on what is convenient.

There's different standards for what constitutes a specific generation. It's best to think of them as "what major events / time periods were the defining period of their early adulthood" Lost Generation = WW1 Greatest Generation = WW2 Silent Generation = Post-WW2/Early Cold War Boomers = Vietnam Generation X = Reagan Generation Y / MILLENNIALS = Post-Desert Storm, 9/11, GWOT Generation Z / "Digital Natives" = GWOT, Great Recession

Harvard cuts Gen X off at 1985 or so. Boomers were '46-65, gen X was '66-85ish. Millenials 85ish-05, then whatever they call kids now. About a decade ago I heard the '06- kids were going to be called Digital Natives or some poo poo, but haven't heard it since and it's probably because of the Native part.
