So what are the odds of Crytek actually landing an injunction on CIG in light of the amended complaint? Their discovery will likely focus on the source code given Daztek's post earlier. I read Smart's analysis of the ruling; I don't like the guy but I gotta admit he had a good point and seem to have been mostly correct in his predictions of how this would proceed.

Despite the legal strategy, there's a certain amount of personal animus here between Crytek and CIG. Anyone who's ever worked with Chris Roberts will know why. Which means they're not necessarily going to go for the fast and clean win. They're going to figure in what makes CIG squirm the most. An injunction is the fastest thing, but gives CIG the out they're looking for. "We were winning until selfish lawyers killed the dream." Discovery while allowing CIG to keep believing they can "develop" the "game" is the funniest answer because it produces the most nervous sweat from the criminal center of this enterprise. Many here believe that discovery will not be public, therefore our LOLs will be limited. To them I say: have you even been following this debacle? CIG is the uncontested champion of unforced errors. Can you imagine the kind of poo poo that's going to happen if discovery proceeds? We'll see daily patches as they scrub stolen art assets that still have the watermarks. We'll see constant code changes and frequent last-moment TOS changes. We'll be able to reverse-engineer, purely from observing CIG's panic-stricken actions, exactly what discovery is turning up. That is the path of most humor.

its really bad because you cannot continue to produce any work while the injunction is in place -- so hands off the keyboard, crobbears although they could continue to create jpgs and sell them, actually, since it could be argued they don't exist in-engine yet and were created with standard art tools that have nothing to do with cryengine code
