Just out of curiosity, my boss runs a dance school and he also received a notice like the one Lowtax got when he used a photo he found on google images as the banner on his page's website. He said he ended up paying this mob 1500 dollars for copyright infringement or whatever. It's not exactly the same situation because my boss actually just copied the image straight onto his website so it does seem a bit more incriminating but is there any ground here for this firm to just straight up demand 1500 dollars without first asking the image to be removed? It seems a bit harsh

No, there is no grounds, that's why it's a scam. As Lowtax explained it - they need to send a DMCA takedown notice and you have 30 days to react. The case would have been thrown out if it ever reached a judge.

It's basically a law firm sending out very official sounding and threatening letters with an arbitrary sum attached to them going "we're still doing you a favor here, if this ever went to court then maybe you'd have to pay way more" and people who have never been sued in their life get scared and pay up to be left alone. The catch is that none of the lawyer's claims are true and if people actually paid attention to how those letters are worded they'd see that the law firm leaves things vague on purpose so that techbically they're not blackmailing you. If it was a done and shut case the wording would have been way more direct.

The problem is that if you go to the wrong lawyer with this you could actually be advised to settle because settlements are always better than going to court, right? Such lawyer has no idea about copyright law and definitely didn't do his homework but why would he when paying him for that could potentially cost more than the settlement sum. That's the genius of scam lawyers demanding small ammounts of money - it's cheaper to just pay them than hiring defense against them.

I have no idea about the exact circumstances there. I'm no lawyer either but it could be that if you agree to pay it counts as admission of guilt that a judge would see differently.

I mean, it's a scam, and it could be possible a federal prosecutor could bring charges for wirefraud or something, but hell if I really know. If they did, he might be a part of a class action civil suit that will never recover anything.

He could also try suing them in civil court, but no telling how that would go. I'm guessing not well.

This is how this type of firm works. They have a handful of people getting paid between $10-15/hr (most likely law students) typing up and sending out these template letters and responding to emails initially. She has zero qualifications listed after her name in her signature, so she's not licensed to practice law, a licensed paralegal, or anything else like that.

So the next step is it gets sent up to an actual paralegal or something that will say "drat we didn't get this one" and shred everything. The paralegal is the front of the investigative team or whatever it's called and would either farm it out to one of the staff attorneys (if there was something legit worth pursuing) or hands it off to an attorney that actually assigns that.

Higbee himself hasn't probably looked at an actual case or document in years and just golfs, interviews people, and cuts checks to his co collaborators.

I'm not sure that stuff applies to 'your own webpage, where you decided to put a photo yourself', though. It applies to things like ISPs, where the ISP isn't the one deciding what images to put on their servers, not to anyone and everyone on the planet.

It still does not matter; the appropriate and accepted legal response to a situation like this begins with the filing of a DMCA complaint, and may only escalate if that notice is ignored for 30 days.
